Executive Order 1213

It is hereby ordered that the E. ½ of the NW. ¼ (80 acres), and the W. ½ of the NE. ¼ (80 acres), sec. 7, T. 17 S., R. 12 W.; the E. ½ of the NW. ¼ (lot 3, 41 acres, and the SE. ¼ NW. ¼, 40 acres), and the E. ½ of the SW. ¼ (80 acres), sec. 1, T. 17 S., R. 13 W.; the E. ½ of the NE. ¼ (80 acres), and lot 1 (26 acres), sec. 11, and lots 3 and 4, sec. 12 (26 acres each) T. 17 S., R. 13 W., N. M. P. M., New Mexico, as shown upon the official plats on file in the General Land Office, approved January 20, 1868, within the limits of the Gila National Forest, declared by proclamation of the President, dated July 21, 1905, a portion of which lands were also withdrawn by order of the Secretary of the Interior, dated January 30, 1907, for nursery site purposes for use of the Forest Service, be, and the same are hereby, reserved for military purposes to protect the water supply of Fort Bayard: Provided, that this withdrawal for use of the War Department shall not revoke the withdrawal of the lands as a part of the Gila National Forest declared by President’s proclamation of July 21, 1905, or the order of the Secretary of the Interior dated January 30, 1907, withdrawing a portion of said lands for nursery site purposes for use of the Forest Service, but all of the withdrawals shall stand together, the withdrawal for the use of the War Department being the dominant one, and whenever the use of the lands as a National Forest or for nursery site purposes does not interfere with the protection of the water supply of Fort Bayard, such uses shall not be interfered with, but the lands shall not be subject to appropriation under any of the public land laws.
