Executive Order 168

In the exercise of the power vested in the President by the Constitution and by virtue of the seventeen hundred and fifty-third section of the Revised Statutes, and of the civil-service act approved January 16, 1883, the following rule for the regulation and improvement of the executive civil service is amended as stated below, and is hereby promulgated.


Section 7 of Rule II is hereby amended by adding thereto the following as a proviso:

Provided, That no such person shall be transferred from any department, office, or branch of the service to a position in another department, office, or branch of the service, until he has passed the examination prescribed for original entrance to the position to which transfer is proposed.


The section as amended will read as follows:

  1. A person holding a position on the date said position is classified under the civil-service act shall be entitled to all the rights and benefits possessed by persons of the same class or grade appointed upon examination under the provisions of said act: Provided, That no such person shall be transferred from any department, office, or branch of the service to a position in another department, office, or branch of the service, until he has passed the examination prescribed for original entrance to the position to which transfer is proposed.
