STIPULATION REGARDING RICHARD REID


IT IS HEREBY STIPULATED AND AGREED by and between Defendant Zacarias Moussaoui ("Moussaoui") and the United States as follows:

  • 1. To date, there is no information available to indicate that Richard Reid ("Reid") had pre-knowledge of the 9/11 attacks or was instructed by al-Qaeda leadership to conduct an operation in coordination with Moussaoui.
  • 2. Moussaoui and Reid are believed to have been close associates, which probably developed during training at the same time frame in Afghanistan. This close relationship was exemplified in an undated "final letter" written by Reid to his mother and recovered at Tarnak Farms in Afghanistan. In this letter or last will and testament, Reid named Abu Khalid Sawahiri (Moussaoui) as the beneficiary of his belongings upon his "passing." In the opinion of two FBI analysts, if Reid was to be part of the same martyrdom operation as Moussaoui, it is highly unlikely he would bequeath his belongings to Moussaoui.
  • 3. FBI investigation and information provided by an al-Qaeda source indicates that Reid and UK citizen Saajid Badat (detained in the UK in November 2003) were designated for other anti-U.S. attacks involving the use of shoe bombs on aircraft in late 2001. According to one detained al-Qaeda operative with information of the 9/11 plot, Reid and Badat were to carry out their operations on the same day, but Badat pulled out for unknown reasons and was never heard from again.
  • 4. FBI investigation determined that all of the 9/11 participants (pilots/non-pilots) were located in the United States by early July 2001, in preparation for the attacks. While Moussaoui was in the U.S. at the time, Reid was traveling between Afghanistan, Pakistan, Amsterdam, the Hague, Israel, and Turkey between May and September 2001. Therefore, again, according to two FBI analysts, it is highly unlikely that Reid was part of this operation.
