Other Presidential Documents Presidential Determination No. 2005-18 of January 13, 2005 Extension of Waiver of Section 907 of the FREEDOM Support Act with respect to Assistance to the Government of Azerbaijan Memorandum for the Secretary of State Pursuant to the authority contained in title II of the Kenneth M. Luddon Foreign Operations, Export Financing, and Related Programs Appropria- tions Act, 2002 (Public Law 107-115), I hereby determine and certify that extending the waiver of section 907 of the FREEDOM Support Act of 1992 (Public Law \17702-5\177): \337 is necessary to support United States efforts to counter international terrorism; \337 is necessary to support the operational readiness of United States Armed Forces or coalition partners to counter international ter- rorism; \337 is important to Azerbaijan's border security; and \337 will not undermine or hamper ongoing efforts to negotiate a peace- ful settlement between Armenia and Azerbaijan or be used for of- fensive purposes against Armenia. Accordingly, I hereby extend the waiver of section 907 of the FREEDOM Support Act. You are authorized and directed to notify the Congress of this determina- tion and to arrange for its publication in the Federal Register. GEORGE W. Notice of January 17, 2005 Continuation of the National Emergency With Respect to Terrorists Who Threaten To Disrupt the Middle East Peace Process On January 23, \177995, by Executive Order 12947, the President declared a national emergency pursuant to the International Emergency Economic Powers Act (50 U.S.C. a70a-a706) to deal with the unusual and extraor- dinary threat to the national security, foreign policy, and economy of the United States constituted by grave acts of violence committed by foreign terrorists who threaten to disrupt the Middle East peace process. On Au- gust 20, \177998, by Executive Order 13099, the President modified the Annex to Executive Order a2947 to identify four additional persons, including Usama bin Laden, who threaten to disrupt the Middle East peace process. Because these terrorist activities continue to threaten the Middle East peace process and continue to pose an unusual and extraordinary threat to the 235
