(2) In section 651, strike "preceding fiscal year." and substitute "preceding fiscal year, including amounts collected as provided under section 664 of this title.". (3) After section 663, add the following new section:

"§ 664. User fees "(a) A fee or charge for a service or thing of value provided by the Coast Guard shall be prescribed as provided in section 9701 of title 31. "(b) Amounts collected by the Secretary for a service or thing of value provided by the Coast Guard shall be deposited in the general fund of the Treasury as proprietary receipts of the department in which the Coast Guard is operating and ascribed to Coast Guard activities. "(c) Before January 1 of each year, the Secretary shall submit a report to the Committee on Merchant Marine and Fisheries of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate that includes— "(1) a verification of each activity for which a fee or charge is

"(A) the amount collected in the prior fiscal year; and "(B) that the amount spent on that activity in that fiscal

year is not less than the amount collected; and ^ ' "(2) the amount expected to be collected in the current fiscal year for each activity for which a fee or charge is expected to be collected.". (b) Title 46, United States Code, is amended as follows: ^ " (1) In section 2101— •iH •< (A) between clauses (20) and (21), insert the following new clause: ^IJ\ti. "(20a) 'overall in length' means— "(A) for a foreign vessel or a vessel engaged on a foreign voyage, the greater of— "(i) 96 percent of the length on a waterline at 85 percent of the least molded depth measured from the top of the keel (or on a vessel designed with a rake of ' keel, on a waterline parallel to the designed waterline); or "(ii) the length from the fore side of the stem to the axis of the rudder stock on that waterline; and >; "(B) for any other vessel, the horizontal distance of the hull between the foremost part of the stem and the aftermost part of the stern, excluding fittings and attachments."; and (B) add at the end the following new clause: "(47) 'vessel of war' means a vessel— "(A) belonging to the armed forces of a country; r:;,:• ' "(B) bearing the external marks distinguishing vessels of m orm i war of that country; "(C) under the command of an officer commissioned by the government of that country and whose name appears in the appropriate service list or its equivalent; and "(D) staffed by a crew under regular armed forces discipline.". (2) Section 2102 is amended by striking "chapters 43" and substituting "chapters 37, 43, 51,".
