SEC. 107. SUBMISSION OF CERTAIN FALSE STATEMENTS A PROHIBITED ACT. (a) KNOWING AND WILLFUL SUBMISSION.—Paragraph (1) of section

307 of the Act (16 U.S.C. 1857(1)) is amended— (1) by striking out "or" at the end of subparagraph (G); (2) by inserting "or" after the semicolon at the end of subparagraph (H); and (3) by adding at the end thereof the following new sulsparagraph: .0 "(I) to knowingly and willfully submit to a Council, the Secretary, or the Governor of a State false information (including, but not limited to, false information regarding the capacity and extent to which a United States fish processor, on an annual 'A basis, will process a portion of the optimum yield of a fishery that will be harvested by fishing vessels of the United States) n regarding any matter that the Council, Secretary, or Governor is considering in the course of carrying out this Act.".

(b) CONFORMING AMENDMENT.—Section 309(a)(1) of the Act (16

U.S.C. 1859(a)(1)) is amended by striking out "or (H)" and inserting "(H), or (J)". SEC. 108. CIVIL PENALTIES.
