PUBLIC LAW 100-690—NOV. 18, 1988 SEC. 6469. AUTHORIZATION OF POSTAL MONEY LAUNDERING.

TO INVESTIGATE

(a) JURISDICTION.—(1) Section 1956 of title 18, United States Code, is amended by striking all that follows "appropriate" in subsection (e) and inserting the following: "and, with respect to offenses over which the United States Postal Service heis jurisdiction, by the Postal Service. Such authority of the Secretary of the Treasury and the Postal Service shall be exercised in accordance with an agreement which shall be entered into by the Secretary of the Treasury, the Postal Service, and the Attorney General." (2) Section 1957 of title 18, United States Code, is amended by striking all that follows "appropriate" in subsection (e) and inserting the following: "and, with respect to offenses over which the United States Postal Service has jurisdiction, by the Postal Service. Such authority of the Secretary of the Treasury and the Postal Service shall be exercised in accordance with an agreement which shall be entered into by the Secretary of the Treasury, the Postal Service, and the Attorney General.". (b) CONFORMING AMENDMENTS.—Section 981 of title 18, United States Code, is amended by— (1) inserting "or the Postal Service" in subsection Oo) following "Secretary of the Treasury" the first two times it appears; (2) striking "the Attorney General or the Secretary of the Treasury" in subsections (b)(2) and (c) through (e) and inserting "the Attorney General, the Secretary of the Treasury, or the Postal Service"; (3) adding a t the end of subsection (d) the following: "The Attorney General shall have sole responsibility for disposing of petitions for remission or mitigation with respect to property involved in a judicial forfeiture proceeding"; and (4) adding at the end of subsection (e) the following: "The authority granted to the Secretary of the Treasury and the Postal Service pursuant to this subsection shall apply only to property that has been administratively forfeited.". (c) POWERS OF THE SECRETARY.—Section 5318(a)(l) of title 31, United States Code, is amended by inserting "or the Postal Inspection Service" after "supervising agency". SEC. 6470. CONTROLLED SUBSTANCES AND RELATED AMENDMENTS. (a) ATTEMPT AND CONSPIRACY AMENDMENTS.—Section 406 of the

Controlled Substance Act (21 U.S.C. 846) and section 1013 of the Controlled Substances Import and Export Act (21 US.C. 963) are amended by striking "is punishable" and all that follows through "punishment" and inserting "shall be subject to the same penalties as those". (b) CLARIFYING AMENDMENTS RELATING TO FORFEITURE OF PROCEEDS OF A FOREIGN DRUG OFFENSE.—Subparagraph (B) of section

981(a)(l) of title 18, United States Code, is amended by— (1) inserting ", real or personal," after "property"; (2) striking "which represents the proceeds of and inserting "constituting, derived from, or traceable to, any proceeds obtained directly or indirectly from"; (3) striking "or activity" the first place it appears; (4) inserting "under the laws of the United States" after "punishable" the second place it appears; and (5) inserting "constituting the ofTense against the foreign nation" after "such act or activity".
