105 STAT. 1380 PUBLIC LAW 102-190—DEC. 5, 1991 "(2) The term 'dependent' has the meaning given such term in section 1072(2) of this title.", (b) CONFORMING AMENDMENTS. — (1) The heading of section 1490 of title 10, United States Code, is amended to read as follows: "§ 1490. Transportation of remains: certain retired members and dependents who die in military medical facilities". (2) The table of sections at the beginning of chapter 75 of such title is amended by striking out the item relating to section 1490 and inserting in lieu thereof the following: "1490. Transportation of remains: certain retired members and dependents who die in military medical facilities.". PART D—MATTERS RELATED TO CONTINGENCY OPERATIONS SEC. 631. DEFINITION OF CONTINGENCY OPERATION. (a) TITLE 10. — Section 101 of title 10, United States Code, is amended by adding at the end the following new paragraph: "(47) The term 'contingency operation' means a military operation that— "(A) is designated by the Secretary of Defense as an operation in which members of the armed forces are or may become involved in military actions, operations, or hostilities against an enemy of the United States or against an opposing military force; or "(B) results in the call or order to, or retention on, active duty of members of the uniformed services under section 672(a), 673, 673b, 673c, 688, 3500, or 8500 of this title, chapter 15 of this title, or any other provision of law during a war or during a national emergency declared by the President or Congress.". (b) TITLE 37. —Section 101 of title 37, United States Code, is amended by adding at the end the following new paragraph: "(26) The term 'contingency operation' has the meaning given that term in section 101(47) of title 10.". SEC. 632. BASIC ALLOWANCE FOR QUARTERS FOR CERTAIN RESERVES WITHOUT DEPENDENTS. (a) PAYMENT REQUIRED.— Section 403(d) of title 37, United States Code, is amended— (1) by inserting "(1)" after "(d)"; and (2) by adding at the end the following new paragraph: "(2) A member of a reserve component without dependents who is called or ordered to active duty in support of a contingency operation (other than a member who is authorized transportation of household goods under section 406 of this title as part of that call or order) may not be denied a basic allowance for quarters if, because of that call or order, the member is unable to continue to occupy a residence— "(A) which is maintained as the primary residence of the member at the time of the call or order; and "(B) which is owned by the member or for which the member is responsible for rental pa3anents.". 37 USC 403 (b) EFFECTIVE DATE. —The amendments made by subsection (a) "^o*^- shall take effect on the date of the enactment of this Act and shall apply to calls or orders of members of the reserve components of the Armed Forces to active duty on or after that date.
