107 STAT. 140 PUBLIC LAW 103-43—JUNE 10, 1993 " OFFICE OF RESEARCH ON MINORITY HEALTH 42 USC 283b. "SEC. 404. (a) ESTABLISHMENT.— T here is established within the Office of the Director of NIH an office to be known as the Office of Research on Minority Health (in this section referred to as the 'Office'). The Office shall be headed by a director, who shall be appointed by the Director of NIH. "(b) PURPOSE.— The Director of the Office shall— "(1) identify projects of resc^arch on minority health that should be conducted or supported by the national research institutes; "(2) identify multidisciplinary research relating to research on minority health that should be so conducted or supported; "(3) promote coordination and collaboration among entities conducting research identified under paragraph (1) or (2); "(4) encourage the conduct of such research by entities receiving funds from the national research institutes; "(5) recommend an agenda for conducting and supporting such research; "(6) promote the sufficient allocation of the resources of the national research institutes for conducting and supporting such research; and "(7) assist in the administration of section 492B with respect to the inclusion of members of minority groups as subjects in clinical research.". Subtitle C—Research Integrity SEC. 161. ESTABLISHMENT OF OFFICE OF RESEARCH INTEGRITY. Section 493 of the Public Health Service Act (42 U.S.C. 289b) is amended to read as follows: " OFFICE OF RESEARCH INTEGRITY Regulations. "SEC. 493. (a) IN GENERAL. — "(1) ESTABLISHMENT OF OFFICE.— Not later than 90 days after the date of enactment of this section, the Secretary shall establish an office to be known as the Office of Research Integrity (referred to in this section as the 'Office'), which sh^l be established as an independent entity in the Department of Health and Human Services. "(2) APPOINTMENT OF DIRECTOR. —The Office shall be headed by a Director, who shall be appointed by the Secretary, be experienced and specially trained in the conduct of research, and have experience in the conduct of investigations of research misconduct. The Secretary shall carry out this section acting through the Director of the Office. The Director shall report to the Secretary. " (3) DEFINITIONS. — "(A) The Secretary shall by regulation establish a definition for the term 'research misconduct' for purposes of this section. "(B) For purposes of this section, the term 'financial assistance' means a grant, contract, or cooperative agreement.
