    • (!) was an eye specialty hospital or an eye and ear

specialty hospital, or "(11) was operated as an eye or eye and ear unit (as defined in subparagraph (B)) of a general acute care hospital which, on the date of the application described in clause (i), operates less than 20 percent of the beds that the hospital operated on October 1, 1987, and has sold or otherwise disposed of a substantial portion of the hospital's other acute care operations, the cost proportion and ASC proportion in effect under subclauses (I) and (II) of paragraph (3)(B)(ii) for cost reporting periods beginning in fiscal ^ear 1988 shall remain in effect for cost reporting periods beginning on or after October 1, 1988, and before January 1, 1995. "(B) For purposes of this subparagraph (A)(iii)(II), the term 'eye or eye and ear unit* means a physically separate or distinct unit containing separate surgical suites devotea solely to eye or eye and ear services.". (b) EFFECTIVE DATE.—The amendments made by subsection (a) shall apply to portions of cost reporting periods beginning on or after January 1, 1994. SEC. 13533. REDUCTION IN PAYMENTS FOR INTRAOCULAR LENSES. Notwithstanding section 1833(i)(2)(A)(iii) of the Social Security Act, the amount of payment determined under such section for an intraocular lens inserted subsequent to or during cataract surgenr in an ambulatory surgical center on or after January 1, 1994, and before January 1, 1999, shall be equal to $150. Subpart D—Durable Medical Equipment SEC. 13641. PAYMENT FOR PARENTERAL AND ENTERAL NUTRIENTS, 42 USC 1395m SUPPLIES, AND EQUIPMENT DURING 1994 AND 1996. note. In determining the amount of payment under part B of title XVIII of the Social Security Act with respect to parenteral and enteral nutrients, supplies, and equipment during 1994 and 1995, the charges determined to be reasonable with respect to such nutrients, supplies, and equipment may not exceed the charges determined to be reasonaole with respect to such nutrients, supplies, and equipment during 1993. SEC. 13642. REVISIONS TO PAYMENT RULES FOR DURABLE MEDICAL EQUIPMENT. (a) BASING NATIONAL PAYMENT LIMITS ON MEDIAN OF LOCAL PAYMENT AMOUNTS.— (1) INEXPENSIVE AND ROUTINELY PURCHASED ITEMS; ITEMS REQUIRING FREQUENT AND SUBSTANTIAL SERVICING.—<A) PARA- graphs (2)(C)(i)(II) and (SXCXiXII) of section 1834(a) (42 U.S.C. 1395m(a)) are each amended— (i) by striking 1992 the first place it appears and inserting "1992, 1993, and 1994"; and (ii) by striking "1992" the second place it appears and inserting "the year'. (B) Paragraphs (2)(C)(ii) and (3)(C)(ii) of section 1834(a) (42 U.S.C. 1395m(a)) are each amended— (i) by striking "and" at the end of subclause (I); (ii) Dy redesignating subclause (II) as subclause (IV); and
