108 STAT. 2378 PUBLIC LAW 103-328—SEPT. 29, 1994 (1) IN GENERAL. —Except as provided in paragraph (2), no provision of law governing procurement or public contracts shall be applicable to the procurement of goods and services necessary for carrying out the provisions of this section. (2) EQUAL EMPLOYMENT OPPORTUNITY. —Paragraph (1) shall not relieve any person entering into a contract under the authority of this section from complying with any law relating to equal employment opportunity. (g) DISTRIBUTION OF SURCHARGES.^AII surcharges received by the Secretary from the sale of coins issued under this section shall be promptly paid by the Secretary to the National Fund for the United States Botanic Garden. (h) AUDITS. — The Comptroller General of the United States shall have the right to examine such books, records, documents, and other data of the National Fund for the United States Botanic Garden as may be related to the expenditures of amounts paid under subsection (g). (i) FINANCIAL ASSURANCES. — (1) No NET COST TO THE GOVERNMENT. —The Secretary shall take all actions necessary to ensure that the issuance of the coins authorized by this section shall result in no net cost to the United States Government. (2) ADEQUATE SECURITY FOR PAYMENT REQUIRED.—No coin J shall be issued under this section unless the Secretary has received— (A) full payment therefor; (B) security satisfactory to the Secretary to indemnify the United States for full payment; or (C) a guarantee of full payment satisfactory to the Secretary from a depository institution whose deposits are insured by the Federal Deposit Insurance Corporation or the National Credit Union Administration Board. SEC. 209. MOUNT RUSHMORE COMMEMORATIVE COINS. (a) DISTRIBUTION OF SURCHARGES. —Section 8 of the Mount Rushmore Commemorative Coin Act (104 Stat. 314; 31 U.S.C. 5112 note) is amended by striking paragraphs (1) and (2) and inserting the following: "(1) the first $18,750,000 shall be paid during fiscal year 1994 by the Secretary to the Society to assist the Society's efforts to improve, enlarge, and renovate the Mount Rushmore National Memorial; and "(2) the remainder shall be returned to the Federal Treasury for purposes of reducing the national debt.". 31 USC 5112 (b) RETROACTIVE EFFECT.— If, prior to the enactment of this "°*®- Act, any amount of surcharges have been received by the Secretary of the Treasury and paid into the United States Treasury pursuant to section 8(1) of the Mount Rushmore Commemorative Coin Act, as in effect prior to the enactment of this Act, that amount shall be paid out of the Treasury to the extent necessary to comply with section 8(1) of the Mount Rushmore Commemorative Coin Act, as in efiiect after the enactment of this Act. Amounts paid pursuant to the preceding sentence shall be out of funds not otherwise appropriated. 31 USC 5112 (c) NUMISMATIC OPERATING PROFITS.— Nothing in this section "°^- shall iDe construed to affect the Secretary of the Treasury's right to derive operating profits from numismatic programs for use in
