PUBLIC LAW 103-337—OCT. 5, 1994 108 STAT. 2799 "(1) Subject to paragraph (3), if an abused dependent of a former member of a uniformed service described in paragraph (4) needs medical or dental care for an injury or illness resulting from abuse by the member, the administering Secretary may, upon request of the abused dependent, furnish medical or dental care to the dependent for the treatment of such injury or illness in facilities of the uniformed services."; and (2) by adding at the end the following new paragraph: "(4)(A) A former member of a uniformed service referred to in paragraph (1) is a member who— "(i) received a dishonorable or bad-conduct discharge or was dismissed from a uniformed service as a result of a courtmartial conviction for an offense, under either military or civil law, involving abuse of a dependent of the member; or "(ii) was administratively discharged from a uniformed service as a result of such an offense. "(B) A determination of whether an offense involved abuse of a dependent of the member shall be made in accordance with regulations prescribed by the administering Secretary for such uniformed service.". (b) CONFORMING AMENDMENTS.—Such subsection is further amended— (1) by inserting "former" before "member" each place it appears in paragraphs (2) and (3); (2) in paragraph (2), by striking out "paragraph (1)(A)" and inserting in lieu thereof "paragraph (4)"; and (3) in paragraph (3)(C)— (A) by striking out "is" and inserting in lieu thereof "was"; and (B) by striking out "paragraph (1)(A)" and inserting in lieu thereof "paragraph (4)". (c) PERSONAL SERVICE CONTRACTS TO PROVIDE CARE. —(1) The lo use io9i Secretary of Defense may enter into personal service contracts under the authority of section 1091 of title 10, United States Code, with persons described in paragraph (2) to provide the services of clinical counselors, family advocacy program staff, and victim's services representatives to members of the Armed Forces and covered beneficiaries who require such services. Notwithstanding subsection (a) of such section, such services may be provided in medical treatment facilities of the Department of Defense or elsewhere as determined appropriate by the Secretary. (2) The persons with whom the Secretary may enter into a personal services contract under this subsection shall include clinical social workers, psychologists, psychiatrists, and other comparable professionals who have advanced degrees in counseling or related academic disciplines and who meet all requirements for State licensure and board certification requirements, if any, within their fields of specialization. SEC. 705. ADDITIONAL AUTHORIZED HEALTH CARE SERVICE AVAIL- ABLE THROUGH MILITARY HEALTH CARE SYSTEM.
