110 STAT. 2844 PUBLIC LAW 104-201—SEPT. 23, 1996 (ii) One shall be appointed by the minority leader of the Senate (in consultation with the majority leader of the Senate). (iii) Two shall be appointed by the Speaker of the House of Representatives (in consultation with the minority leader of the House of Representatives). (iv) One shall be appointed by the minority leader of the House of Representatives (in consultation with the Speaker of the House of Representatives). (v) Two shall be appointed by the Secretary of Energy. (B) Members shall be appointed for the life of the Commission. Any vacancy in the Commission shall not affect its powers, but shall be filled in the same manner as the original appointment. (C) The chairman of the Commission shall be designated from among the members of the Commission appointed under subparagraph (A) by the majority leader of the Senate, in consultation with the Speaker of the House of Representatives, the minority leader of the Senate, and the minority leader of the House of Representatives. Deadline. (D) Members shall be appointed not later than 60 days after the date of the enactment of this Act. Procedures. (2) The members of the Commission shall establish procedures for the activities of the Commission, including procedures for calling meetings, requirements for quorums, and the manner of taking votes. (c) DUTIES. —(1) The Commission shall develop a plan for recruiting and retaining within the Department of Energy nuclear weapons complex such scientific, engineering, and technical personnel as the Commission determines appropriate in order to permit the Department to maintain over the long term a safe and reliable nuclear weapons stockpile without engaging in underground testing. (2) In developing the plan, the Commission shall— (A) identify actions that the Secretary may undertake to attract qualified scientific, engineering, and technical personnel to the nuclear weapons complex of the Department; and (B) review and recommend improvements to the on-going efforts of the Department to attract such personnel to the nuclear weapons complex. (d) REPORT. —Not later than March 15, 1998, the Commission shall submit to the Secretary and to Congress a report containing the plan developed under subsection (c). The report may include recommendations for legislation and administrative action. (e) COMMISSION PERSONNEL MATTERS.—(1) Each member of the Commission who is not an officer or employee of the FedersJ Government shall be compensated at a rate equal to the daily equivalent of the annual rate of basic pay prescribed for level IV of the Executive Schedule under section 5315 of title 5, United States Code, for each day (including travel time) during which such member is engaged in the performance of the duties of the Commission. All members of the Commission who are officers or employees of the United States shall serve without compensation in addition to that received for their services as officers or employees of the United States. (2) The members of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of chapter 57 of title 5, United States Code, while away from their homes or
