"(h) A reemployed annuitant as to whom a waiver under subsection (g) is in effect shall not be considered a participant for purposes of subchapter I or subchapter II, or an employee for purposes of chapter 83 or 84 of title 5, tJnited States Code.". SEC. 104. Title II of the Omnibus Diplomatic Security and Antiterrorism Act of 1986 (Public Law 99-399) is amended by adding the following new section at the end: " SEC. 206. CONTRACTING AUTHORITY. 22 USC 4824. "The Secretary of State is authorized to employ individuals or organizations by contract to carry out the purposes of this Act, and individuals employed by contract to perform such services shall not by virtue of such employment be considered to be employ- ees of the United States Government for purposes of any law administered by the Office of Personnel Management (except that the Secretary may determine the applicability to such individuals of any law administered by the Secretary concerning the employ- ment of such individuals); and such contracts are authorized to be negotiated, the terms of the contracts to be prescribed, and the work to be performed, where necessary, without regard to such statutory provisions as relate to the negotiation, making and performance of contracts and performance of work in the United States.". SEC. 106. INTRASTATE BUS TRANSPORTATION IN HAWAII. Section 14501(a)(1) of Title 49, United States Code, is amended by striking "operations" and inserting "operations, or to intrastate bus transportation of any nature in the State of Hawaii". SEC. 107. Provisions of 23 U.S.C. 125(b)(1) shall not apply to emergency relief projects resulting from the flooding in the State of California in January and March 1995. SEC. 108. For the purpose of any Rule of the House of Representatives, notwithstanding any other provision of law, any obligation limitation relating to surface treinsportation projects under section 1602 of P.L. 105-178 shall be assumed to be administered on the basis of sound program management practices that are consistent with past practices of the administering agency permitting States to decide High Priority Project funding priorities within state program allocations. SEC. 109. OPERATION OF TRAILERS, (a) REGISTRATION OF TRAIL- 49 USC 31701 ERS.—A State that requires annual registration of container chassis ^°^- and the apportionment of fees for such registrations in accordance with the International Registration Plan (as defined under section 31701 of title 49, United States Code) shall not limit the operation, or require the registration, in the State of a container chassis (or impose fines or penalties on the operation of a container chassis for being operated in the State without a registration issued by the State) if such chassis— (1) is registered under the laws of another State; and (2) is operating under a trip permit issued by the State, (b) LIMITATION ON REGISTRATION OF TRAILERS. —A State described in subsection (a) may not deny the use of trip permits for the operation in the State of a container chassis that is registered under the laws of another State.
