113 STAT. 386 PUBLIC LAW 10&-53 —AUG. 17, 1999 (2) SUBMISSION OF PLAN TO SECRETARY. —On completion of a plan for terrestrial wildlife habitat restoration, the State of South Dakota, the Cheyenne River Sioux Tribe, and the Lower Brule Sioux Tribe shall submit the plan to the Secretary. (3) REVIEW BY SECRETARY AND SUBMISSION TO COMMIT- TEES.— The Secretary shall review the plan and submit the plan, with any comments, to the appropriate committees of the Senate and the House of Representatives, (4) FUNDING FOR CARRYING OUT PLANS. — (A) STATE OF SOUTH DAKOTA. — (i) NOTIFICATION.—On receipt of the plan for terrestrial wildlife habitat restoration submitted by the State of South Dakota, each of the committees referred to in paragraph (3) shall notify the Secretary of the receipt of the plan. (ii) AVAILABILITY OF FUNDS.— On notification in accordsince with clause (i), the Secretsiry shall make available to the State of South Dakota funds from the South Dakota Terrestrial Wildlife Habitat Restoration Trust Fund established under section 603, to be used to carry out the plan for terrestrial wildlife habitat restoration submitted by the State and only after the Trust Fund is fully capitalized. (B) CHEYENNE RIVER SIOUX TRIBE AND LOWER BRULE SIOUX TRIBE.— (i) NOTIFICATION.—On receipt of the plan for terrestrial wildlife habitat restoration submitted by the Cheyenne River Sioux Tribe and the Lower Brule Sioux TribMB, each of the committees referred to in peirsigraph (3) shall notify the Secretary of the Treasury of the receipt of each of the plans. (ii) AVAILABILITY OF FUNDS.— On notification in accordance with clause (i), the Secretary of the Treasury shall meike available to the Cheyenne River Sioux TVibe and the Lower Brule Sioux Tribe funds from the Cheyenne River Sioux Tribe Terrestrial Wild- Hfe Habitat Restoration Trust Fund and the Lower Brule Sioux Tribe Terrestrial Wildlife Habitat Restoration Trust Fund, respectively, established under section 604, to be used to ceirry out the plan for terrestrial wildlife habitat restoration submitted by the Cheyenne River Sioux Tribe and the Lower Brule Sioux Tribe, respectively, and only after the Trust Fund is fully capitedized. (C) TRANSITION PERIOD.— (i) IN GENERAL.—During the period described in clause (ii), the Secretary shall— (I) fund the terrestrial wildlife habitat restoration programs being carried out on the date of enactment of this Act on Oahe and Big Bend project land and the plans established under this section at a level that does not exceed the highest amount of funding that was provided for the programs during a previous fiscal year; and (II) fund the activities described in sections 603(d)(3) and 604(d)(3).
