PUBLIC LAW 109–171—FEB. 8, 2006 SEC. 6054. DSH ALLOTMENT FOR THE DISTRICT OF COLUMBIA.

(a) IN GENERAL.—For purposes of determining the DSH allotment for the District of Columbia under section 1923 of the Social Security Act (42 U.S.C. 1396r–4) for fiscal year 2006 and each subsequent fiscal year, the table in subsection (f)(2) of such section is amended under each of the columns for fiscal year 2000, fiscal year 2001, and fiscal year 2002, in the entry for the District of Columbia by striking ‘‘32’’ and inserting ‘‘49’’. (b) EFFECTIVE DATE.—The amendments made by subsection (a) shall take effect as if enacted on October 1, 2005, and shall only apply to disproportionate share hospital adjustment expenditures applicable to fiscal year 2006 and subsequent fiscal years made on or after that date. SEC. 6055. INCREASE IN MEDICAID PAYMENTS TO INSULAR AREAS.

Section 1108(g) of the Social Security Act (42 U.S.C. 1308(g)) is amended— (1) in paragraph (2), by inserting ‘‘and subject to paragraph (3)’’ after ‘‘subsection (f)’’; and (2) by adding at the end the following new paragraph: ‘‘(3) FISCAL YEARS 2006 AND 2007 FOR CERTAIN INSULAR AREAS.—The amounts otherwise determined under this subsection for Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa for fiscal year 2006 and fiscal year 2007 shall be increased by the following amounts: ‘‘(A) For Puerto Rico, $12,000,000 for fiscal year 2006 and $12,000,000 for fiscal year 2007. ‘‘(B) For the Virgin Islands, $2,500,000 for fiscal year 2006 and $5,000,000 for fiscal year 2007. ‘‘(C) For Guam, $2,500,000 for fiscal year 2006 and $5,000,000 for fiscal year 2007. ‘‘(D) For the Northern Mariana Islands, $1,000,000 for fiscal year 2006 and $2,000,000 for fiscal year 2007. ‘‘(E) For American Samoa, $2,000,000 for fiscal year 2006 and $4,000,000 for fiscal year 2007. Such amounts shall not be taken into account in applying paragraph (2) for fiscal year 2007 but shall be taken into account in applying such paragraph for fiscal year 2008 and subsequent fiscal years.’’. Subchapter A—Family Opportunity Act SEC. 6061. SHORT TITLE OF SUBCHAPTER.

This subchapter may be cited as the ‘‘Family Opportunity Act of 2005’’ or the ‘‘Dylan Lee James Act’’. SEC. 6062. OPPORTUNITY FOR FAMILIES OF DISABLED CHILDREN TO PURCHASE MEDICAID COVERAGE FOR SUCH CHILDREN.

(a) STATE OPTION TO ALLOW FAMILIES OF DISABLED CHILDREN TO PURCHASE MEDICAID COVERAGE FOR SUCH CHILDREN.— (1) IN GENERAL.—Section 1902 of the Social Security Act (42 U.S.C. 1396a) is amended— (A) in subsection (a)(10)(A)(ii)— (i) by striking ‘‘or’’ at the end of subclause (XVII);
