PUBLIC LAW 110–5—FEB. 15, 2007 the Inter-American Investment Corporation’; and ‘Multilateral Economic Assistance, Funds Appropriated to the President, Contribution to the European Bank for Reconstruction and Development’. ‘‘SEC. 20405. (a) Of the unobligated balances available from funds appropriated under the heading ‘Funds Appropriated to the President, International Financial Institutions, Contribution to the International Development Association’ in the Foreign Operations, Export Financing, and Related Programs Appropriations Act, 2006 (Public Law 109–102), $31,350,000 is rescinded. ‘‘(b) Of the unobligated balances available from funds appropriated under the heading ‘Bilateral Economic Assistance, Funds Appropriated to the President, Other Bilateral Economic Assistance, Economic Support Fund’, $200,000,000 is rescinded: Provided, That such amounts shall be derived only from funds not yet expended for cash transfer assistance. ‘‘SEC. 20406. Notwithstanding any other provision of this division, the eighth proviso under the heading ‘Bilateral Economic Assistance, Funds Appropriated to the President, United States Agency for International Development, Development Assistance’ in the Foreign Operations, Export Financing, and Related Programs Appropriations Act, 2006 (Public Law 109–102) shall not apply to funds appropriated by this division. ‘‘SEC. 20407. Section 599D of the Foreign Operations, Export Financing, and Related Programs Appropriations Act, 2006 (Public Law 109–102) is amended by striking ‘certifies’ and all that follows and inserting the following: ‘reports to the appropriate congressional committees on the extent to which the World Bank has completed the following: ‘‘ ‘(1) World Bank procurement guidelines have been applied to all procurement financed in whole or in part by a loan from the World Bank or a credit agreement or grant from the International Development Association (IDA). ‘‘ ‘(2) The World Bank proposal ‘‘Increasing the Use of Country Systems in Procurement’’ dated March 2005 has been withdrawn. ‘‘ ‘(3) The World Bank maintains a strong central procurement office staffed with senior experts who are designated to address commercial concerns, questions, and complaints regarding procurement procedures and payments under IDA and World Bank projects. ‘‘ ‘(4) Thresholds for international competitive bidding have been established to maximize international competitive bidding in accordance with sound procurement practices, including transparency, competition, and cost-effective results for the Borrowers. ‘‘ ‘(5) All tenders under the World Bank’s national competitive bidding provisions are subject to the same advertisement requirements as tenders under international competitive bidding. ‘‘ ‘(6) Loan agreements between the World Bank and the Borrowers have been made public.’. ‘‘SEC. 20408. Section 523 of the Foreign Operations, Export Financing, and Related Programs Appropriations Act, 2006 (Public Law 109–102) shall be applied to funds made available under this division by substituting ‘$1,022,086,000’ for the first dollar amount.
