S.C. 201 3 (b)) (referred to in this subsection as the ‘ ‘food package ’ ’)
(2) the e x tent to which the food package— (A) addresses the nutritional needs of low - income Native Americans compared to the supplemental nutrition assistance program, particularly for very low-income house- holds; ( B ) conforms (or fails to conform) to the 200 5D ietary G uidelines for Americans published under section 301 of the National Nutrition M onitoring and R elated Research Actof1 9 90 (7 U.S.C. 5341); (C) addresses (or fails to address) the nutritional and health challenges that are specific to Native Americans; and (D) is limited by distribution costs or challenges in infrastructure; and (3)(A) any plans of the Secretary to revise and update the food package to conform with the most recent Dietary Guidelines for Americans, including any costs associated with the planned changes; or (B) if the Secretary does not plan changes to the food package, the rationale of the Secretary for retaining the food package. PARTI II —COM MO D IT YSU PP LE ME N TAL F OOD PRO G RAM SEC.42 2 1 .C OM MO DITY S UP P L EME N T A L F OOD P R O G RAM. Section 5 of the Agriculture and Consumer P rotection Act of 1973 (7 U.S.C. 6 12c note; Public L aw 93 – 86) is amended by striking subsection (g) and inserting the following
‘‘(g) P ROHIB I T IO N .—Notwithstanding any other provision of law (including regulations), the Secretary may not re q uire a State or local agency to prioriti z e assistance to a particular group of individ- uals that are— ‘‘(1) low-income persons aged 60 and older; or ‘‘(2) women, infants, and children.’’. PART I V —SENIOR FARMERS ’ MAR K ET NUTRITION PROGRAM SEC. 42 3 1. SENIORS FARMERS ’ MAR K ET NUTRITION PROGRAM. Section 4402 of the Farm Security and Rural Investment Act of 2002 (7 U.S.C. 3007) is amended— (1) in subsection (b)(1), by inserting ‘‘honey,’’ after ‘‘vegeta- bles,’’; (2) by striking subsection (c) and inserting the following: ‘‘(c) EXCLUS ION O F B E NEFITS IN DETER M ININ G ELIGIBILIT Y FOR O THER PROGR A MS.— T he value of any benefit provided to any eligible seniors farmers’ market nutrition program recipient under this
