12 2 STA T . 12 6 6 PUBLIC LA W 11 0– 2 34—M A Y 22 , 200 8‘ ‘ (I I )ther e s e a r c h of the I n st i t u te su p p l e m ents an d enhances , and does not supplant, research conducted or funded by other F ederal a g encies . ‘‘( D ) COMPENSATI ON. —T he Director shall recei v e basic payataratenottoe x ceed the maximum amount of com - pensation payable to a member of the S enior E xecutive Service under subsection (b) of section 5382 of title 5, U nited States Code, except that the certification re q uire- ment in that subsection shall not apply to the compensation of the Director. ‘‘(E) AU T H O R IT Y AN D RESPONSI B I L ITIES O F DIRE C TOR.— Except as other w ise specifically provided in this subsection, the Director shall— ‘‘(i) exercise all of the authority provided to the Institute by this subsection

‘‘(ii) formulate and administer programs in accord- ance with policies adopted by the Institute, in coordina- tion with the Under Secretary; ‘‘(iii) establish offices within the Institute; ‘‘(iv) establish procedures for the provision and administration of grants by the Institute; and ‘‘(v) consult regularly with the Advisory B oard. ‘‘( 4 ) R E G ULATIONS.—The Institute shall have such authority as is necessary to carry out this subsection, including the authority to promulgate such regulations as the Institute con- siders to be necessary for governance of operations, organi z a- tion, and personnel. ‘‘(5) ADMINISTRATION.— ‘‘(A) IN GENERAL.—The Director shall organize offices and functions within the Institute to administer funda- mental and applied research and extension and education programs. ‘‘(B) RESEARCH PRIORITIES.—The Director shall ensure the research priorities established by the Under Secretary through the Research, Education and Extension O ffice are carried out by the offices and functions of the Institute, where applicable. ‘‘(C) FUNDAMENTAL AND APPLIED RESEARCH.—The Director shall— ‘‘(i) determine an appropriate balance between fun- damental and applied research programs and functions to ensure future research needs are met; and ‘‘(ii) designate staff, as appropriate, to assist in carrying out this subparagraph. ‘‘(D) COMPETITI V ELY FUNDED A W ARDS.—The Director shall— ‘‘(i) promote the use and growth of grants awarded through a competitive process; and ‘‘(ii) designate staff, as appropriate, to assist in carrying out this subparagraph. ‘‘(E) COORDINATION.—The Director shall ensure that the offices and functions established under subparagraph (A) are effectively coordinated for maximum efficiency. ‘‘( 6 ) FUNDING.— ‘‘(A) IN GENERAL.—In addition to funds otherwise appropriated to carry out each program administered by the Institute, there are authorized to be appropriated such Procedu re s.
