12 2 STA T . 11 6PUBLIC LA W 11 0– 1 8 1 —J A N .28 , 2008 of f icers,and c u rren t assi g n m ent, p romotion, and j oint officer de v e l opment policies for general and flag officers .(2)ADVICEOF C HA I RM A N OF J OIN T CHIEF S OF STAFF. —Th e S ecretar y shall develop the strategic plan re q uired under paragraph ( 1 ) w ith the advice of the C hairman of the J oint Chiefs of Staff. ( 3 ) M ATTERS TO B E INC LU DED.—The strategic plan required under paragraph (1) shall include the following

(A) A description of the process for identification of the present and emerging requirements for general and flag officers and recommendations for meeting these requirements. ( B ) I dentification of the num b ers of general and flag officers by service, grade, and qualifications currently avail - able compared with the numbers needed to meet e x isting statutory requirements in support of the overall missions of the D epartment of Defense. (C) An assessment of the problems or issues (and pro- posed solutions for any such problems or issues) arising from existing numerical limitations on the number and grade distribution of active and reserve component general and flag officers under sections 5 25, 52 6 , and12 0 0 4 of title 10, U nited States Code. (D) A discussion of how wartime requirements for addi- tional general or flag officers have been addressed in sup- port of O peration E nduring F reedom and Operation Iraqi Freedom, including the usage of wartime or national emer- gency authorities. (E) An assessment of any problems or issues (and proposed solutions for any such problems or issues) arising from existing statutory provisions regarding general and flag officer assignments and grade requirements and the need, if any, for revision of provisions in title 10, United States Code, specific to individual general and flag officer positions along with recommendations to mitigate the need for routine legislative intervention as positions change to support organi z ational demands. (F) An assessment of the use currently being made of reserve component flag and general officers and discus- sion of barriers to the qualification, selection, and assign- ment of N ational G uard and R eserve officers for the broadest possible range of positions of importance and responsibility. (4) DEADLINE FOR SUBMISSION.—The Secretary shall submit the plan required under paragraph (1) to the Committees on Armed Services of the Senate and the H ouse of Representatives not later than March 1, 200 9 . SEC.54 4. PROHIB I T IO NAG AINST M EMBERS O F THE ARME D FORCES PARTICIPATING IN CRIMINA L STREET GANGS.
