and ( 2 ) by inserting after subsection (c) t h e follo w ing new sub- section
‘‘(d) N otwithstanding subsection (b), during the p eriod begin- ning on O ctober 1, 200 8 , through D ecember 3 1, 2010, a member may accumulate up to 7 5 days of lea v e.’’. (b) CON F ORMIN G AMENDMENTS R ELATED TO H IG H DEPLOYMENT M EM B ERS.—Subsection (f) of such section is amended— (1) in paragraph (1)(A), by striking ‘‘any accumulated leave ine x cess of 6 0 days at the end of the fiscal year’’ and inserting ‘‘at the end of the fiscal year any accumulated leave in excess of the number of days of leave authori z ed to be accumulated under subsection (b) or (d)’’; (2) in paragraph (1)(C)— (A) by striking ‘‘60 days’’ and inserting ‘‘the days of leave authorized to be accumulated under subsection (b) or (d) that are’’; and ( B ) by inserting ‘‘(or fourth fiscal year, if accumulated while subsection (d) is in effect)’’ after ‘‘third fiscal year’’; and (3) in paragraph (2), by striking ‘‘except for this para- graph—’’ and all that follows through the end of the paragraph and inserting ‘‘except for this paragraph, would lose at the end of that fiscal year any accumulated leave in excess of the number of days of leave authorized to be accumulated under subsection (b) or (d), shall be permitted to retain such leave until the end of the second fiscal year after the fiscal year in which such service on active duty is terminated.’’. (c) CONFORMING AMENDMENT RELATED TO MEMBERS IN MISSING STATUS.—Subsection (g) of such section is amended by striking ‘‘60-day limitation in subsection (b) and the 9 0-day limitation in subsection (f)’’ and inserting ‘‘limitations in subsections (b), (d), and (f)’’. (d) P AY.—Section 501(b) of title 37, United States Code, is amended by adding at the end the following new paragraph: ‘‘(6) An enlisted member of the armed forces who would lose accumulated leave in excess of 120 days of leave under section 701(f)(1) of title 10 may elect to be paid in cash or by a check on the Treasurer of the United States for any leave in excess so accumulated for up to 30 days of such leave. A member may make an election under this paragraph only once.’’. SEC. 55 2 . ENHANCEMENT OF REST AND RECUPERAT I ON LEAVE. Section 705(b)(2) of title 10, United States Code, is amended by inserting ‘‘for members whose q ualifying tour of duty is 12 months or less, or for not more than 20 days for members whose qualifying tour of duty is longer than 12 months,’’ after ‘‘for not more than 15 days’’.
