‘(7) REFUNDO F AS SESS M EN T SON C E R TA I NIM P ORTED PROD - UCTS. — ‘‘(A) I N G ENERA L .—An im p o r ter shall be entitled to a ref u nd of any assessment paid under this subsection on imported dairy products imported under a contract entered into prior to the date of enactment of the F ood , Conser v ation, and E nergy Act of 2 008. ‘‘( B )E X PIRATION.—Refunds under subparagraph (A) shall e x pire 1 year after the date of enactment of the Food, Conservation, and Energy Act of 2008. ’ ’. SEC.1508 . R E PO R T O ND EP A RT M ENT O F A G R I C UL TURE REPORTING PROCEDURES FOR NONFAT DR Y MIL K . N ot later than 90 days after the date of enactment of this Act, the Secretary shall submit to the Committee on Agriculture of the H ouse of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report regarding D epart- ment of Agriculture reporting procedures for nonfat dry mil k and the impact of the procedures on Federal milk marketing order minimum prices during the period beginning on J uly 1, 200 6 , and ending on the date of enactment of this Act. SEC. 150 9 . FEDERAL MILK MARKETING ORDER RE V IE W COMMISSION. (a) ESTA B LIS H MENT.—Sub j ect to the availability of appropria- tions to carry out this section, the Secretary shall establish a commission to be known as the ‘‘Federal M ilk Marketing O rder Review Commission’’ (referred to in this section as the ‘‘commis- sion’’), which shall conduct a comprehensive review and evaluation of— (1) the Federal milk marketing order system in effect on the date of establishment of the commission

and (2) non-Federal milk marketing order systems. (b) ELEMENTS OF RE V IE W AND EVALUATION.—As part of the review and evaluation under subsection (a), the commission shall consider legislative and regulatory options for— (1) ensuring that the competitiveness of dairy products with other competing products in the marketplace is preserved and enhanced; (2) enhancing the competitiveness of American dairy pro- ducers in world markets; (3) ensuring the competitiveness and transparency in dairy pricing; (4) streamlining and expediting the process by which amendments to Federal milk market orders are adopted; (5) simplifying the Federal milk marketing order system; (6) evaluating whether the Federal milk marketing order system serves the interests of dairy producers, consumers, and dairy processors; and (7) evaluating the nutritional composition of milk, including the potential benefits and costs of adjusting the milk content standards. (c) MEMBERSHIP.— (1) COMPOSITION.— T he commission shall consist of 14 mem- bers. (2) MEMBERS.—As soon as practicable after the date on which funds are first made available to carry out this section,
