(d) REGULATIONS . — (1) I N GENE R AL.— N ot later than April 1, 2008, the Sec- retary of Defense shall prescribe regulations to implement the amendments to section 1477 of title 10, U nited States C ode, made by subsection (a). (2) E LE M ENTS.— T he regulations re q uired by paragraph (1) shall include forms for the making of the designation con- templated by subsection (a) of section 1477 of title 10, United States Code, as amended by subsection (a) of this section, and instructions for members of the Armed F orces in the filling out of such forms. SEC.64 6.C LARIF ICA T I ON OFA P PLICATION OF RETIRE D PA YMU LTI - PLIER PERCENTA G ETOMEM B ERSOFT H E UNIFORMED SER V ICES W ITH OVER 30 YEARS OF SERVICE. (a) COM P UTATION O F RETIRE D AND RETAINER P A Y FOR M EM B ERS OF NA V AL SERVI C E.—The table in section 6 3 33(a) of title 10, United States Code, is amended in Column 2 of Formula A by striking ‘ ‘75 percent. ’ ’ and inserting ‘‘Retired pay multiplier prescribed under section 140 9 for the years of service that may be credited to the member under section 1405.’’. (b) RETIRED PAY FOR CERTAIN MEMBERS RECALLED TO ACTIVE DUTY.—The table in section 1402(a) of such title is amended by striking Column 3. (c) EFFECTIVE DATE.—The amendments made by subsections (a) and (b) shall take effect as of January 1, 2007, and shall apply with respect to retired pay and retainer pay payable on or after that date. SEC. 64 7 . COMMENCEMENT OF RECEIPT OF NON-REGULAR SERVICE RETIRED PAY BY MEMBERS OF THE READY RESERVE ON ACTIVE FEDERAL STATUS OR ACTIVE DUTY FOR SIGNIFI- CANT PERIODS. (a) REDUCED ELIGIBILITY AGE.—Section 12731 of title 10, United States Code, is amended— (1) in subsection (a), by striking paragraph (1) and inserting the following

‘‘(1) has attained the eligibility age applicable under sub- section (f) to that person

’’; and (2) by adding at the end the following new subsection: ‘‘(f)(1) Sub j ect to paragraph (2), the eligibility age for purposes of subsection (a)(1) is 60 years of age. ‘‘(2)(A) In the case of a person who as a member of the Ready Reserve serves on active duty or performs active service described in subparagraph ( B ) after the date of the enactment of the National Defense Authori z ation Act for Fiscal Y ear 2008, the eligibility age for purposes of subsection (a)(1) shall be reduced below 60 years of age by three months for each aggregate of 90 days on which such person so performs in any fiscal year after such date, subject Ap p licab ili ty.10USC 1 4 0 2no t e .
