F unds app r opriated under the headin g s ‘ ‘Foreign M ilitary Financing P rogra m’ ’ and ‘‘Peace k eeping O perations’’ by the D epartment of State , Foreign Operations, and R elated Programs Appropriations Act, 2008 (di v ision J of Public L a w 110 – 1 6 1) and by prior Acts making appropriations for foreign operations, e x port financing, and related programs may be used to transfer, e q uip, upgrade, refurbish or lease helicopters or related equipment nec - essary to support the operations of the African U nion / United N ations peacekeeping operation in Darfur, Sudan, that was estab- lished pursuant to United Nations Security C ouncil Resolution 1 7 6 9 . T he President may utili z e the authority of sections 5 06 or 516 of the Foreign Assistance Act of 1961 (22 U.S.C. 2 3 18, 2321 j ) or section 61 of the Arms Export Control Act (22 U.S.C. 2796) in order to provide such support, notwithstanding any other provi- sion of law except for sections 502 B (a)(2), 620A and 620J of the Foreign Assistance Act of 1961 (22 U.S.C. 2304(a)(2), 2371, 2378d) and section 40A of the Arms Export Control Act (22 U.S.C. 2780). Any exercise of the authorities provided by section 506 of the Foreign Assistance Act pursuant to this section may include the authority to acquire helicopters by contract. TI B ET SEC. 1412. (a) Of the funds appropriated by this Act or prior Acts making appropriations for the Department of State, foreign operations and related programs under the headings ‘‘Diplomatic and Consular Programs’’ and ‘‘Embassy Security, Construction, and Maintenance’’, up to $ 5,000,000 shall be made available to establish a United States Consulate in Lhasa, Tibet. (b) The Department of State should not consent to opening a consular post in the United States by the People’s Republic of China until such time as the People’s Republic of China consents to opening a United States consular post in Lhasa, Tibet. J ORDAN ( INC L UDING RE S CISSION OF FUNDS ) SEC. 1413. (a) For an additional amount for ‘‘Economic Support Fund’’ for assistance for Jordan, $25,000,000, to remain available until September 30, 2009. (b) For an additional amount for ‘‘Foreign Military Financing Program’’ for assistance for Jordan, $33,000,000, to remain available until September 30, 2009. (c) Of the unobligated balances of funds appropriated under the heading ‘‘Millennium Challenge Corporation’’ in prior Acts making appropriations for foreign operations, export financing, and related programs, $58,000,000 are rescinded. (d) Section 8002 of this Act shall not apply to this section. ALLOCATIONS SEC. 1414.
