(d) D EF INITION S .— S ection 18 1 of such title is further amended b y adding at the end the following new subsection

‘‘(g) DEFINITIONS.—In this section: ‘‘(1) The term ‘joint military requirement’ means a capa - bility necessary to fulfill a gap in a core mission area of the Department of Defense. ‘‘( 2 ) The term ‘core mission area’ means a core mission area of the Department of Defense identified under the most recent quadrennial roles and missions review pursuant to sec- tion 118b of this title.’’. (e) CONS UL TATION.—Section 2 43 3(e)(2) of such title is amended by inserting ‘‘, after consultation with the Joint Requirements Over- sight Council regarding program requirements,’’ after ‘‘Secretary of Defense’’ in the matter preceding subparagraph ( A ). (f) DEA D LINES.— E ffective June 1, 2 0 0 9 , all joint military requirements documents of the Joint Requirements Oversight Council produced to carry out its mission under section 181(b)(1) of title 10, U nited States Code, shall reference the core mission areas organi z ed and defined under section 118b of such title. N ot later than October 1, 2009, all such documents produced before June 1, 2009, shall reference such structure. SEC.943 . R E QUI RE M E NTFO R CERTIFIC A TION OF MA J ORS Y STEMS P RIOR TO TEC H NO L O G Y D E V ELOPMENT. (a) RE Q UIRE M ENT FOR CERTIFI C ATION.— (1) IN GENERAL.—Chapter 139 of title 10, United States Code, is amended by inserting after section 23 6 6a the following new section: ‘ ‘ §236 6 b.Majordef e ns ea cqui si t ion p ro g ra m s

certification required before Mi l estone A or K e yD ecision P oint A appro v al ‘‘(a) CERTIFICATION.—A major defense acquisition program may not receive M ilestone A approval, or K ey Decision P oint A approval in the case of a space program, until the Milestone Decision Authority certifies, after consultation with the Joint Requirements Oversight Council on matters related to program requirements and military needs— ‘‘(1) that the system fulfills an approved initial capabilities document

‘‘(2) that the system is being e x ecuted by an entity with a relevant core competency as identified by the Secretary of Defense under section 118b of this title; ‘‘(3) if the system duplicates a capability already provided by an existing system, the duplication provided by such system is necessary and appropriate; and ‘‘(4) that a cost estimate for the system has been submitted and that the level of resources required to develop and procure the system is consistent with the priority level assigned by the Joint Requirements Oversight Council.
