(2) by redesignating part J of title I V (as added by section 8 02 of the College Cost Reduction and Access Act) as part F of title III , and mo v ing such part so that such part follo w s part E of title III; and ( 3 ) by redesignating section 49 9A (as added by section 802 of such Act) as section 3 7 1. (b) CON F O RM ING AMENDMENTS.—Section 371 (as redesignated by subsection (a)(3)) is amended— (1) in subsection (b)(2)(C)(i), by stri k ing ‘ ‘title III ’ ’ each place the term appears and inserting ‘‘this title’’; and (2) in subsection (c)(9)(F), by striking ‘‘title III’’ and inserting ‘‘this title’’. (c) A V AILA B ILIT Y OFF U NDS.— P aragraph (1) of section 371(b) (as redesignated by subsection (a)(3)) is amended to read as follows

‘‘(1) IN GENERAL.— ‘‘(A) PROVISION OF FUNDS.—There shall be available to the Secretary to carry out this section, from funds in the Treasury not otherwise appropriated, $ 2 5 5,000,000 for each of the fiscal years 2008 and 2009. The authority to award grants under this section shall e x pire at the end of fiscal year 2009. ‘‘( B ) AVAILABILITY.—Funds made available under subparagraph (A) for a fiscal year shall remain available for the next succeeding fiscal year.’’. SEC. 31 7 . TECHNICAL ASSISTANCE. Section 391 (20 U.S.C. 10 6 8) is amended by adding at the end the following: ‘‘(e) TEC H NICAL ASSISTANCE.—The Secretary, directly or by grant or contract, may provide technical assistance to eligible institutions to prepare the institutions to qualify, apply for, and maintain a grant, under this title.’’. SEC. 31 8 . W AIVER AUTHORITY. Section 392 (20 U.S.C. 1068a) is amended by adding at the end the following: ‘‘(c) W AIVER AUTHORITY WITH RES P ECT TO INSTITUTIONS L OCATED IN AN AREA AFFECTED BY A GULF H URRICANE D ISASTER.— ‘‘(1) WAIVER AUTHORITY.— N otwithstanding any other provi - sion of law, unless enacted with specific reference to this sec- tion, for any affected institution that was receiving assistance under this title at the time of a Gulf hurricane disaster, the Secretary shall, for each of the fiscal years 2009 through 2011 (and may, for each of the fiscal years 2012 and 2013)— ‘‘(A) waive— ‘‘(i) the eligibility data requirements set forth in section 391(d); ‘‘(ii) the wait-out period set forth in section 313(d); ‘‘(iii) the allotment requirements under section 324; and Expirat i ond at e.20USC1 0 67q . 20 USC 10 9 9e. 20 USC 1066 ets e q.
