S EC . 8078. None of the funds available to the Department of Defense may be obligated to modify command and control rela - tionships to give F leet Forces Command administrative and oper- ational control of U.S. Navy forces assigned to the Pacific fleet: Provide d, That the command and control relationships which e x isted on O ctober 1, 2004, shall remain in force unless changes are specifically authori z ed in a subse q uent Act. SEC. 8079. Notwithstanding any other provision of law or regu- lation, the Secretary of Defense may exercise the provisions of section 7403 ( g ) of title 38, United States Code, for occupations listed in section 7403(a)(2) of title 38, United States Code, as well as the following: Pharmacists, Audiologists, Psychologists, Social W orkers, Othotists/Prosthetists, Occupational Therapists, Physical Therapists, Rehabilitation Therapists, Respiratory Therapists, Speech Pathologists, Dietitian/Nutritionists, I ndustrial Hygien- ists, Psychology Technicians, Social Service Assistants, Prac- tical Nurses, Nursing Assistants, and Dental Hygienists: (A) The requirements of section 7403(g)(1)(A) of title 38, United States Code, shall apply. (B) The limitations of section 7403(g)(1)(B) of title 38, United States Code, shall not apply. SEC. 8080. Funds appropriated by this Act, or made available by the transfer of funds in this Act, for intelligence activities are deemed to be specifically authorized by the Congress for purposes of section 5 04 of the National Security Act of 1947 (50 U.S.C. 414) during fiscal year 2009 until the enactment of the Intelligence Authorization Act for Fiscal Y ear 2009. SEC. 8081. None of the funds provided in this Act shall be available for obligation or expenditure through a reprogramming of funds that creates or initiates a new program, pro j ect, or activity unless such program, project, or activity must be undertaken imme- diately in the interest of national security and only after written prior notification to the congressional defense committees. SEC. 8082. (a) In addition to the amounts provided elsewhere in this Act, $3,000,000 is hereby appropriated to the Department of Defense for ‘‘Operation and M aintenance, Army National G uard’’. Such amount shall be made available to the Secretary of the Army only to make a grant in the amount of $3,000,000 to the entity specified in subsection (b) to facilitate access by veterans to opportunities for skilled employment in the construction industry. (b) The entity referred to in subsection (a) is the Center for Military Recruitment, Assessment and V eterans E mployment, a nonprofit labor-management cooperation committee provided for by section 302(c)(9) of the Labor-Management Relations Act, 1947 (29 Grants.No t if i c ation.
