SEC.513 . C LARIF ICA T I ON OFA U T H ORIT Y TO CONSI D ERFORA V ACANCY P RO M OTION NATIONAL G UARD OFFICERS ORDERED TO ACTIVE DUTY IN SUPPORT OF A CONTIN - GENCY OPERATION. ( a ) A D D IT I ONALEXCEP TION. —S u bsec tion (d) o f section 1 4317 of title 10, U nited States C ode, is amended— (1)int h e first sentence— (A) by stri k in g ‘‘E x ce p t’’ and inserting ‘‘(1) Except’’

( B ) by striking ‘‘unless the officer is ordered’’ and inserting ‘‘unless the officer— ‘‘(A) is ordered’’; (C) by striking the period at the end and inserting ‘‘; or’’; and ( D ) by adding at the end the follo w ing new subpara - graph: ‘‘(B) has been ordered to or is ser v ing on active duty in support of a contingency operation.’’; and (2) in the second sentence, by striking ‘‘ I f’’ and inserting the following: ‘‘(2) If’’. (b) CON S IDE R ATION F OR P RO M OTION BY EXAMINATION FOR F ED- ERAL R ECO G NITION.—Subsection (e)(1)(B) of such section is amended by inserting before the period at the end the following: ‘‘, or by examination for Federal recognition under title 32’’. SEC. 51 4 . INCREASE IN MANDATORY RETIREMENT AGE FOR CERTAIN RESERVE OFFICERS. (a) SELECTI V E SERVICE AND PROPERTY AND FISCAL O FFICERS.— Section 12647 of title 10, United States Code, is amended by striking ‘‘60 years’’ and inserting ‘‘62 years’’. (b) CERTAIN RESERVE OFFICERS IN GRADES OF M A J OR TH RO U GH BRIGADIER GENERAL.—Section 14702(b) of such title is amended— (1) in the subsection heading, by striking ‘‘AT AGE 60’’ and inserting ‘‘FOR AGE’’; and (2) by striking ‘‘subsection (a)(1) or (a)(2).’’ and all that follows through the period at the end of the last sentence and inserting the following: ‘‘paragraph (1) or (2) of subsection (a). An officer described in paragraph (1) of such subsection may not be retained under this section after the last day of the month in which the officer becomes 62 years of age. An officer described in paragraph (2) of such subsection may not be retained under this section after the last day of the month in which the officer becomes 60 years of age.’’. (c) CLERICAL AMENDMENTS.— (1) SECTION HEADING.—The heading of section 14702 of such title is amended to read as follows:
