(b) I MPLE ME NTA T IO N. — ( 1 ) THR O UG H MEMORAN D UMO F UNDER S TANDING.—The memorandum of understanding required by section 861(a) of the N ational Defense Authori z ation Act for F iscal Y ear 20 08 ( P ublic L aw 110 – 181

U .S. C . 2302 note) shall be modified to address the requirements under the amend- ment made by subsection (a) not later than 120 days after the date of the enactment of this Act. (2) AS C ONDITION OF CURRENT AND FUTURE CONTRACTS.— The requirements under the amendment made by subsection (a) shall be included in each contract in Iraq or Afghanistan (as defined in section 86 4 (a)(2) of Public Law 110–181; 2302 note) awarded on or after the date that is 180 days after the date of the enactment of this Act. Federal agencies shall make best efforts to provide for the inclusion of such require- ments in covered contracts awarded before such date. (c) R EPORTING RE Q UIREMENT.—Beginning not later than 2 7 0 days after the date of the enactment of this Act, the Secretary of Defense shall make publicly available a numerical accounting of alleged offenses described in section 861(b)(6) of Public Law 110–181 that have been reported under that section that occurred after the date of the enactment of this Act. The information shall be updated no less frequently than semi-annually. (d) DEFINITIONS.—Section 864(a) of the National Defense Authorization Act for Fiscal Year 2008 (Public Law 110-181; 122 Stat. 253; 10 U.S.C. 2302 note) is amended— (1) by redesignating paragraphs (5) and (6) as paragraphs (6) and (7), respectively; and (2) by inserting after paragraph (4) the following new para- graph: ‘‘(5) CONTRACTOR PERSONNEL.—The term ‘contractor per- sonnel’ means any person performing work under contract for the Department of Defense, the Department of State, or the United States Agency for International Development, in Iraq or Afghanistan, including individuals and subcontractors at any tier.’’. SEC.85 5.S U S P E N S IO NO F S TA TUTES OF L I M ITATIONS WH EN CON -GR ESS AUTHORI Z ES THE USE OF MILITAR Y FORCE. Section 3287 of title 18, United States Code, is amended— (1) by inserting ‘‘or Congress has enacted a specific authorization for the use of the Armed Forces, as described in section 5(b) of the War Powers Resolution (50 U.S.C. 1544(b)),’’ after ‘‘is at war’’; (2) by inserting ‘‘or directly connected with or related to the authorized use of the Armed Forces’’ after ‘‘prosecution of the war’’; (3) by striking ‘‘three years’’ and inserting ‘‘5 years’’; Deadlin e .
