Subti t leH—O t h e rMa tter sSEC.8 8 1 . E XPAN S IO NO F A UTH O R IT Y TO RETAIN FEES FRO ML ICENSIN G OF INTELLECTUAL PROPERTY. Section 2260 of title 10, U nited States Code, is amended— (1) in subsection (a), by inserting ‘ ‘or the Secretary of H omeland Security’’ after ‘‘Secretary of Defense’’
and (2) in subsection (f)— (A) by stri k ing ‘‘(f) DEFINITIONS.— I n this section, the’’ and inserting the following: ‘‘(f) DEFINITIONS.—In this section: ‘‘(1) The’’; and (B) by adding at the end the following new paragraph: ‘‘(2) The term ‘Secretary concerned’ has the meaning pro - vided in section 101(a)( 9 ) of this title and also includes— ‘‘(A) the Secretary of Defense, with respect to matters concerning the Defense Agencies and Department of Defense Field Activities; and ‘‘(B) the Secretary of Homeland Security, with respect to matters concerning the Coast Guard when it is not operating as a service in the Department of the Navy.’’. SEC. 88 2 . REPORT ON MAR K ET RESEARCH. Not later than O ctober 1, 2009, the Secretary of Defense shall submit to the Committees on Armed Services of the Senate and the House of Representatives a report on the implementation of section 826 of the National Defense Authorization Act for Fiscal Y ear 2008 (Public L aw 110-181; 10 U.S.C. 2 37 7 note) and the amendments made by that section. The report shall address— (1) actions taken by the Department of Defense to imple- ment the amendments made by section 826(a) of such Act to section 2377 of title 10, United States Code, with a particular focus on— (A) the guidance issued by the Department on the performance of market research; (B) the market research being performed pursuant to such guidance; and (C) the results of such guidance and market research; (2) training tools the Secretary of Defense has developed to assist contracting officials in performing market research in accordance with section 826(b) of such Act;
