( d ) A P P LICAB ILI TY T OC LA S SI F I ED A N NE X . — This section applies to any classified anne x to the J oint E xplanatory S tatement referred to in subsection (a). (e) OR AL AND W RITTEN CO M M U NICATION.— N o oral or written communication concerning any amount specified in the Joint Explanatory Statement referred to in subsection (a) shall supersede the re q uirements of this section. (a) CON V EYANCE AUT H ORI Z ED.—The Secretary of the Navy is authori z ed to convey the floating drydoc k A FDL–23 , located in Aransas P ass, Texas, to G ulf Copper Ship R epair, that company being the current lessee of the drydock. (b) CONDITION OF CONVEYANCE.—The Secretary shall require as a condition of the conveyance under subsection (a) that the drydock remain at the facilities of Gulf Copper Ship Repair, at Aransas Pass, Texas, until at least September 30, 2010. (c) CONSIDERATION.—As consideration for the conveyance of the drydock under subsection (a), the purchaser shall provide com- pensation to the U nited States the value of which, as determined by the Secretary, is equal to the fair market value of the drydock, as determined by the Secretary. The Secretary shall take into account amounts paid by, or due and owing from, the lessee. (d) TRANSFER AT NO COST TO UNITED STATES.—The provisions of section 7 30 6 (c) of title 10, United States Code, shall apply to the conveyance under this section. (e) ADDITIONAL TERMS AND CONDITIONS.—The Secretary may require such additional terms and conditions in connection with the conveyance under subsection (a) as the Secretary considers appropriate to protect the interests of the United States. SEC. 101 2 . REPORT ON REPA I RO F NAVA L VESSEL IN FOREI G NS H IP - YARDS. Section 7310 of title 10, United States Code, is amended by adding at the end the following new subsection

‘(c) REPORT.—(1) The Secretary of the Navy shall submit to Congress each year, at the time that the President ’ s budget is submitted to Congress that year under section 110 5 (a) of title 31, a report listing all repairs and maintenance performed on any covered naval vessel that has undergone work for the repair of the vessel in any shipyard outside the United States or Guam (in this section referred to as a ‘foreign shipyard’) during the fiscal year preceding the fiscal year in which the report is submitted. ‘‘(2) The report shall include the percentage of the annual ship repair budget of the Navy that was spent on repair of covered Ap p licab ili ty.
