12 2 STA T .48 8 PUBLIC LA W 11 0– 181 —J A N .28 , 2008 ‘ ‘ (d)CASEM A N A G E R.— ( 1 ) TheS e cr e ta r ys ha l l des ign ate a case m anager fo r each indi v id u al descri b ed in subsection (a) to be res p on - sible for the implementation of the plan developed for that indi- vidual under that subsection and the coordination of the individual ’ s medical care. ‘‘( 2 ) The Secretary shall ensure that each case manager has specific e x pertise in the care re q uired by the individual for w hom the case manager is designated , regardless of whether the case manager obtains such expertise through experience, education, or training. ‘‘(e) P AR TIC I P ATI O NAN D CO L LA B ORATION IN D E V ELOP M ENT O F PLANS.—(1) The Secretary shall involve each individual described in subsection (a), and the family or legal guardian of such indi- vidual, in the development of the plan for such individual under that subsection to the maximum extent practicable. ‘‘(2) The Secretary shall collaborate in the development of a plan for an individual under subsection (a) with a State protection and advocacy system if— ‘‘( A ) the individual covered by the plan requests such collaboration

or ‘‘( B ) in the case of such an individual who is incapacitated, the family or guardian of the individual requests such collabora- tion. ‘‘( 3 ) I n the case of a plan required by subsection (a) for a member of the Armed F orces who is serving on active duty, the Secretary shall collaborate with the Secretary of Defense in the development of such plan. ‘‘( 4 ) In developing vocational rehabilitation ob j ectives required under subsection (b)(1) and in conducting the assessment required under subsection (c), the Secretary shall act through the U nder Secretary for H ealth in coordination with the V ocational R ehabilita- tion and E mployment Service of the Department of Veterans Affairs. ‘‘(f) EVAL U ATION.— ‘‘(1) PERIODIC REVIE W B Y SECRETARY.—The Secretary shall periodically review the effectiveness of each plan developed under subsection (a). The Secretary shall refine each such plan as the Secretary considers appropriate in light of such review. ‘‘(2) RE Q UEST FOR REVIEW BY VETERANS.—In addition to the periodic review required by paragraph (1), the Secretary shall conduct a review of the plan for an individual under paragraph (1) at the request of the individual, or in the case of an individual who is incapacitated, at the request of the guardian or designee of the individual. ‘‘(g) STATE DESIGNATED PROTECTION AND ADVOCACY SYSTEM DEFINED.—In this section, the term ‘State protection and advocacy system’ means a system established in a State under subtitle C of the Developmental Disabilities Assistance and Bill of Rights Actof2 0 00 (42 U.S.C. 1 5 041 et seq.) to protect and advocate for the rights of persons with development disabilities. ‘ ‘ §17 1 0D.Traum a ticb rai n in j ur y: c o m p r eh en s i v e pro g ram f or l ong - term rehabilitation ‘‘(a) COMPRE H ENSIVE PROGRAM.—In developing plans for the rehabilitation and reintegration of individuals with traumatic brain injury under section 1 7 10C of this title, the Secretary shall develop and carry out a comprehensive program of long-term care for post- acute traumatic brain injury rehabilitation that includes residential,
