(e) RA TIFI C ATION OF P RO P O S ED CONSTR U CTION AND L AND AC Q UISITION PRO J ECTS U SING F ISCA LY EAR 200 7O PERATION AND M AINTENANCE FUNDS.— T he nine construction pro j ects outside the United States proposed to be carried out using funds appropriated to the D epartment of Defense for operation and maintenance for fiscal year 2007, but for which the obligation or expenditure of funds was prohibited by subsection (g) of section 2 8 08 of the Military Construction Authori z ation Act for Fiscal Year 200 4 (division B of Public Law 1 08 – 1 36; 117 Stat. 1723), as added by section 280 9 of the Military Construction Authorization Act for Fiscal Year 2006 (division B of Public Law 109–163; 119 Stat. 3 5 08), may be carried out using such funds after the date of the enactment of this Act notwithstanding such subsection (g). SEC.280 2.C LARIF ICA T I ON OF RE QU IRE M ENT FOR AUT H ORI Z ATION OF MILITAR Y CONSTRUCTION. (a) CLARIFICATION OF REQUIREMENT FOR AUT H ORI Z ATION.—Sec- tion 2802(a) of title 10, United States Code, is amended by inserting after ‘‘military construction projects’’ the following
‘‘, land ac q uisi- tions, and defense access road projects (as described under section 210 of title 23)’’. (b) CLARIFICATION OF DEFINITION.—Section 2801(a) of such title is amended by inserting after ‘‘permanent requirements’’ the fol- lowing: ‘‘, or any acquisition of land or construction of a defense access road (as described in section 210 of title 23)’’. SEC. 280 3 . INCREASE IN THRESHOL D S FOR UNS P ECIFIED MINOR MILI - TARY CONSTRUCTION PRO J ECTS. Section 2805(a)(1) of title 10, United States Code, is amended by striking ‘‘$1,500,000’’ and inserting ‘‘$2,000,000’’. SEC. 280 4 . TEMPORARY AUTHORITY TO SUPPORT RE V ITALIZATION OF DEPARTMENT OF DEFENSE LA B ORATORIES THROU G H UNSPECIFIED MINOR MILITARY CONSTRUCTION PROJECTS. (a) LA B ORATOR Y RE V ITALIZATION.—Section 2805 of title 10, United States Code, is amended— (1) by redesignating subsection (d) as subsection (e); and (2) by inserting after subsection (c) the following new sub- section (d): ‘‘(d) LABORATORY REVITALIZATION.—(1) For the revitalization and recapitalization of laboratories owned by the United States and under the jurisdiction of the Secretary concerned, the Secretary concerned may obligate and expend— ‘‘(A) from appropriations available to the Secretary con- cerned for operation and maintenance, amounts necessary to carry out an unspecified minor military construction project costing not more than $2,000,000; or ‘‘(B) from appropriations available to the Secretary con- cerned for military construction not otherwise authorized by law, amounts necessary to carry out an unspecified minor mili- tary construction project costing not more than $4,000,000.
