(a)INGE NE RAL.—TheS e cr e t ar ys ha l l m a n a g ean dp r o tect paleontolog i cal reso u rces on F ederal land using scienti f ic principles and e x pertise. The Secretary shall de v elop appropriate plans for inventory , monitoring, and the scientific and educational use of paleontological resources, in accordance w ith applica b le agency laws, regulations, and policies. These plans shall emphasi z e inter - agency coordination and collaborative efforts where possible with non-Federal partners, the scientific community, and the general public. (b) CO OR DI NA T ION.—To the extent possible, the Secretary of the Interior and the Secretary of A griculture shall coordinate in the implementation of this subtitle. SEC. 6303. PUBLI CA W A R ENESS AN D EDUCATI O N PROGRAM. The Secretary shall establish a program to increase public awareness about the significance of paleontological resources. SEC. 630 4 . COLLECTION O F PALEONTOLOGICAL RESOURCES. (a) P ER M IT R E QU IREMENT.— ( 1 )IN G ENERAL.— E xcept as provided in this subtitle, a paleontological resource may not be collected from Federal land without a permit issued under this subtitle by the Secretary. ( 2 )CA S UAL C OLLECTING E X CE P TION.—The Secretary shall allow casual collecting without a permit on Federal land con- trolled or administered by the B ureau of L and M anagement, the Bureau of Reclamation, and the Forest Service, where such collection is consistent with the laws governing the management of those Federal land and this subtitle. ( 3 ) PRE V IOUS PERMIT EXCEPTION.— N othing in this section shall affect a valid permit issued prior to the date of enactment of this Act. (b) CRITERIA F OR ISSUANCE OF A PERMIT.—The Secretary may issue a permit for the collection of a paleontological resource pursu- ant to an application if the Secretary determines that— (1) the applicant is q ualified to carry out the permitted activity
(2) the permitted activity is underta k en for the purpose of furthering paleontological knowledge or for public education; (3) the permitted activity is consistent with any manage- ment plan applicable to the Federal land concerned; and ( 4 ) the proposed methods of collecting will not threaten significant natural or cultural resources. (c) PERMIT SPECIFICATIONS.—A permit for the collection of a paleontological resource issued under this section shall contain such terms and conditions as the Secretary deems necessary to carry out the purposes of this subtitle. Every permit shall include requirements that— (1) the paleontological resource that is collected from Fed- eral land under the permit will remain the property of the U nited States; (2) the paleontological resource and copies of associated records will be preserved for the public in an approved reposi- tory, to be made available for scientific research and public education; and 16USC470a aa –3. 16 USC 470aaa– 2 .
