( 5 ) the health and en v iron m ental compliance standards the S ecretary has established for military and contractor oper - ations in I raq and A fghanistan w ith regard to solid waste disposal , including an assessment of whether those standards are being met; ( 6 ) a description of the environmental, health, and oper- ational impacts of open-pit burning of plastics and the feasi- bility of including plastics in the regulations prescribed pursu- ant to subsection (a); and ( 7 ) an assessment of the ability of e x isting medical surveil- lance programs to identify and trac k exposures to toxic sub- stances that result from open-air burn pits, including rec- ommendations for such changes to such programs as would be required to more accurately identify and track such expo- sures . (c) DEFIN I T I O N S . — In this section

( 1 ) T he term ‘ ‘contingency operation ’ ’ has the meaning given that term by section 1 0 1(a)(1 3 ) of title 10, U nited States C ode. ( 2 ) The term ‘‘covered waste’’ includes— (A) ha z ardous waste, as defined by section 1004(5) of the Solid W aste Disposal Act (42 U.S.C. 6 9 03(5)); ( B ) medical waste; and (C) other waste as designated by the Secretary. SEC.318 . MIL I TARY M UN ITI O NS RES P ONSE SITES. (a) INFO RMA TION S H ARIN G .—Section 2710(a)(2)(B) of title 10, United States Code, is amended by inserting ‘‘, including the county, where applicable,’’ after ‘‘political subdivisions of the State’’. (b) M I L ITAR Y M U NITIONS R ES P ONSE P ROGRAM AN D INSTALLA- TION RESTORATION PROGRAM.—As part of the annual budget submis- sion of the Secretary of Defense to Congress, the Secretary shall include the funding levels requested for the Military Munitions Response Program and the Installation Restoration Program. PU B LIC - PRI V ATE COMPETITION RE Q UIRE D BE F ORE CONVERSION OF ANY DEPARTMENT OF DEFENSE FUNC- TION PERFORMED BY CIVILIAN EMPLOYEES TO CON- TRACTOR PERFORMANCE. (a) RE Q UIREMENT.—Paragraph (1) of section 2461(a) of title 10, United States Code, is amended— (1) by striking ‘‘A function’’ and inserting ‘‘ N o function’’; (2) by striking ‘‘10 or more’’; and (3) by striking ‘‘may not be converted’’ and inserting ‘‘may be converted’’. (b) E FFE C TI V E DATE.—The amendments made by subsection (a) shall apply with respect to a function for which a public-private competition is commenced on or after the date of the enactment of this Act. 10USC246 1 note.
