(b) AD D IT I ONALDU TI ES . —I n addition to the duties of the Panel under se c tion 11 8 (f) of title 1 0,U nited S tates C ode, the Panel shall, w ith respect to the 2 00 9Q D R — (1) re v iew the Secretar y of Defense ’ s terms of reference, and any other materials providing the basis for, or substantial inputs to, the wor k of the Department of Defense on the 2009 QDR

(2) conduct an assessment of the assumptions, strategy, findings, and risks in the report of the Secretary of Defense on the 2009 QDR, with particular attention paid to the risks described in that report; ( 3 ) conduct an independent assessment of a variety of pos - sible force structures for the Armed F orces, including the force structure identified in the report of the Secretary of Defense on the 2009 QDR; and ( 4 ) review the resource re q uirements identified in the 2009 QDR pursuant to section 118(b)(3) of title 10, United States Code, and, to the e x tent practicable, make a general comparison of such resource requirements with the resource requirements to support the forces contemplated under the force structures assessed under paragraph (3). (c) RE P O R TS.— (1) INITIAL REPORT O F PANEL.— T he report on the 2009 QDR that is submitted to Congress pursuant to section 118(f)(2) of title 10, United States Code, shall include, in addition to any other matters required by such section, the interim findings of the Panel with respect to the matters specified in subsection (b). (2) FINAL REPORT OF PANEL.— N ot later than J uly 1 5 , 2010, the Panel shall submit to the Secretary of Defense, and to the congressional defense committees, the final report of the Panel on the matters specified in subsection (b). The report shall include such recommendations on such matters as the Panel considers appropriate. (3) REPORT OF SE C RETAR Y OF DEFENSE.—Not later than August 15, 2010, the Secretary of Defense shall, after consulta- tion with the Chairman of the Joint Chiefs of Staff, submit to the congressional defense committees a report setting forth the Secretary’s response to the final report of the Panel under paragraph (2). (d) TER M INATION OF PANEL.—The Panel shall terminate 45 days after the date on which the Panel submits its final report under subsection (c)(2). SEC.1062 .C ONGR ESS I ON AL EAR M AR K S RELA T INGTOT H E D E P ART - MENT O F DEFENSE. (a) REPORT ON RECURRIN GE ARMAR K S.— (1) REPORT RE Q UIRED.—Not later than 90 days after the date of the enactment of this Act, the Secretary of Defense shall submit to the congressional defense committees a report regarding covered earmarks. (2) ELEMENTS.—The report required by paragraph (1) shall include the following

(A) An identification of each covered earmark that has been included in a national defense authori z ation Act 10USC23 02 note.
