Subti t leB—Na ti on al D e f en s e Sto ckp ile SEC. 1411. AUT H ORI Z ED USES OF NATIONAL DEFENSE STOC KP ILE FUNDS. (a) OBLIGAT I ON O FS TO CKP IL EFU N DS . — During fiscal year 2010, the N ational Defense Stoc k pile M anager may obligate up to $41,1 79 ,000 of the funds in the National Defense Stockpile Trans - action Fund established under subsection (a) of section 9 of the Strategic and C ritical Materials Stock Piling A ct (50 U .S.C. 9 8 h) for the authorized uses of such funds under subsection (b)(2) of such section, including the disposal of hazardous materials that are environmentally sensitive. (b) ADDITIONAL OBLIGATIONS.—The National Defense Stockpile Manager may obligate amounts in e x cess of the amount specified in subsection (a) if the National Defense Stockpile Manager notifies Congress that extraordinary or emergency conditions necessitate the additional obligations. The National Defense Stockpile Manager may make the additional obligations described in the notification after the end of the 45-day period beginning on the date on which Congress receives the notification. (c) L I M ITATIONS.—The authorities provided by this section shall be subject to such limitations as may be provided in appropriations Acts. SEC. 141 2 . E X TENSION OF PRE V IOUSL Y AUTHORIZED DISPOSAL OF COBALT FRO M NATIONAL DEFENSE STOCKPILE. Section 3305(a)(5) of the National Defense Authorization Act for Fiscal Y ear 1998 (Public Law 105 – 85; 50 U.S.C. 98d note), as most recently amended by section 1412(b) of the Duncan H unter National Defense Authorization Act for Fiscal Year 2009 (Public Law 110–417; 122 Stat. 4648), is further amended by striking ‘ ‘during fiscal year 2009 ’ ’ and inserting ‘‘by the end of fiscal year 2011’’. SEC. 141 3 . REPORT ON IMPLEMENTATION OF RECONFIGURATION OF THE NATIONAL DEFENSE STOCKPILE. (a) REPO R TRE Q UIRED.—Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense shall submit to the Committees on Armed Services of the Senate and House of Representatives a report on any actions the Secretary plans to take in response to the recommendations contained in the report entitled ‘‘Reconfiguration of the National Defense Stockpile Report to Congress’’ dated April 2009 and submitted by the Under Sec- retary of Defense for Acquisition, Logistics, and Technology, as required by House Report 109–89, House Report 109–452, and Senate Report 110–115.
