and (2) by striking paragraph (2) and inserting the follo w ing new paragraphs
‘‘(2) if the c u rrent estimate of the cost of the repair pro j ect e x ceeds 75 percent of the estimated cost of a military construc - tion project to replace the facility, an explanation of the reasons why replacement of the facility is not in the best interest of the G o v ernment; and ‘‘( 3 ) a description of the elements of military construction, including the elements specified in section 2802(b) of this title, incorporated into the repair project . ’’. SEC. 280 3 . MODIFICATION OF AUT H ORITY FOR SCOPE OF W OR KV ARI - ATIONS. Section 2853 of title 10, United States Code, is amended— (1) in subsection (b)— ( A ) by striking ‘‘ E xcept as provided in subsection (c)’’ and inserting ‘‘(1) Except as provided in subsection (c)’’; ( B ) by striking ‘‘may be reduced by not more than 25 percent from the amount approved for that project, construction, improvement, or ac q uisition by Congress.’’ and inserting ‘‘may be reduced by not more than 25 percent from the amount specified for that project, construction, improvement, or acquisition in the justification data pro- vided to Congress as part of the request for authori z ation of the project, construction, improvement, or acquisition.’’; and (C) by adding at the end the following new paragraph: ‘‘(2) T he scope of work for a military construction project or for the construction, improvement, and acquisition of a military family housing project may not be increased above the amount specified for that project, construction, improvement, or acquisition in the justification data provided to Congress as part of the request for authorization of the project, construction, improvement, or acquisition.’’; and (2) in subsection (c), by striking ‘‘limitation on scope reduc- tion in subsection (b)’’ and inserting ‘‘limitation on scope reduc- tion in subsection (b)(1)’’. SEC. 280 4 . MODIFICATION OF CONVEYANCE AUTHORITY AT MILITARY INSTALLATIONS. (a) LIM I TEDPURPOS ES F OR WH I C H R E AL PROPERT YM AY BE CO NV EYED.—Section 28 69 of title 10, United States Code, is amended— (1) in subsection (a)— (A) in paragraph (1)— (i) by striking ‘‘agrees, in exchange for the real property—’’ and all that follows through ‘‘to carry out a military construction project or land acquisition’’ and inserting ‘‘agrees, in exchange for the real property, to carry out a land acquisition’’; (ii) by striking ‘‘; or’’ and inserting a period; and (iii) by striking subparagraph (B); and
