(b) C LUSTER M UNITIONS.—No military assistance shall be fur- nished for cluster munitions, no defense export license for cluster munitions may be issued, and no cluster munitions or cluster muni- tions technology shall be sold or transferred, unless— ( 1 ) the submunitions of the cluster munitions, after arming, do not result in more than 1 percent unexploded ordnance across the range of intended operational environments
and ( 2 ) the agreement applicable to the assistance, transfer, or sale of such cluster munitions or cluster munitions tech- nology specifies that the cluster munitions will only be used against clearly defined military targets and will not be used where civilians are k nown to be present or in areas normally inhabited by civilians. O f the funds appropriated or made available pursu- ant to title II of this Act, not to exceed $100,500 shall be for official residence expenses of the United States Agency for Inter- national Development during the current fiscal year: Provided, That appropriate steps shall be taken to assure that, to the maximum extent possible, United States-owned foreign currencies are utilized in lieu of dollars. (a) AUTHORITY.—Up to $93,000,000 of the funds made available in title III of this Act to carry out the provisions ofpartIofthe F oreign Assistance Act of 1961, including funds appropriated under the heading ‘ ‘Assistance for E urope, Eurasia and Central Asia ’ ’, may be used by the United States Agency for International Development (USAID) to hire and employ individ- uals in the United States and overseas on a limited appointment basis pursuant to the authority of sections 308 and 309 of the Foreign Service Act of 1980.
