SEC. 333. DEFICIT-NEUTRAL RESERVE FUND FOR COUNTY PAYMENTS LEGISLATION. The chairman of the House Committee on the Budget may revise the allocations, aggregates, and other appropriate levels in this resolution for any bill, joint resolution, amendment, or conference report that provides for the reauthori z ation of the S ecure Rural Schools and Community Self D etermination Act of 2 000 ( Public Law 10 6–39 3 ) or makes changes to the Payments in Lieu of Ta x es Act of 19 7 6 (Public Law 9 4 – 5 65) by the amounts provided in such measure if such measure would not increase the deficit or decrease the surplus for either time period provided in clause 10 of rule XXI of the Rules of the House of Representatives. SEC. 33 4 . RESERVE FUND FOR THE SURFACE TRANSPORTATION REAUTHORI Z ATION. The chairman of the House Committee on the Budget may revise the allocations, aggregates, and other appropriate levels in this resolution for any bill, joint resolution, amendment, or conference report that reauthorizes surface transportation programs or that authorizes other transportation-related spending by providing new contract authority by the amounts provided in such measure if such measure establishes or maintains a solvent Highway Trust F und over the period of fiscal years 2009 through 2015. ‘ ‘Solvency ’ ’ is defined as a positive cash balance. Such measure may include a transfer into the Highway Trust Fund from other Federal funds, as long as the transfer of Federal funds is fully offset. (a) S ENAT EP OI NTO FORD ER. — (1) IN G ENERA L .—Except as otherwise provided in this sec- tion, it shall not be in order in the Senate to consider any bill or joint resolution (or amendment, motion, or conference report on that bill or joint resolution) that would cause the discretionary spending limits in this section to be exceeded. (2) S UP ER M A J ORIT YW AI V ER AND APPEAL S .— (A) W AIVER.—This subsection may be waived or sus- pended in the Senate only by the affirmative vote of three- fifths of the M embers, duly chosen and sworn.
