123STA T .40 2 PUBLIC LA W 111 –5—FE B.1 7, 200 9‘ ‘ (A)on o rafte rA ug u s t 1,20 0 9 ,oneor m ore c ert i fi - cations d escri b ed in subsection (b)( 3 ) are made w it h res p ect to the communit y; and ‘‘( B ) the community submits the petition not l ater than 1 8 0 days after the date of the most recent certification . ‘‘(2) SPECIALRU LE W I TH RE S PECT T O CERTAI N CO M MU- NITIES. —I n the case of a community with respect to which one or more certifications described in subsection (b)(3) were made on or after J anuary 1, 200 7 , and before August 1, 2009, the community may submit not later than F ebruary 1, 2010, a petition to the Secretary for an affirmati v e determination under subsection (b)(1). ‘‘(b) A F FIRMATI V E D ETERMINATION.— ‘‘(1) IN G ENERAL.— T he Secretary shall ma k e an affirmative determination that a community is eligible to apply for assist- ance under this subchapter if the Secretary determines that the community is a community impacted by trade. ‘‘(2) C OMMUNIT Y IMPACTE DB Y TRADE.—A community is a community impacted by trade if— ‘‘(A) one or more certifications described in paragraph (3) are made with respect to the community; and ‘‘(B) the Secretary determines that the community is significantly affected by the threat to, or the loss of, j obs associated with any such certification. ‘‘(3) CERTIFICATION DESCRIBED.—A certification described in this paragraph is a certification— ‘‘(A) by the Secretary of L abor that a group of workers in the community is eligible to apply for assistance under section 223; ‘‘(B) by the Secretary of Commerce that a firm located in the community is eligible to apply for adjustment assist- ance under section 2 5 1; or ‘‘(C) by the Secretary of Agriculture that a group of agricultural commodity producers in the community is eligible to apply for adjustment assistance under section 293. ‘‘(c) N OTIFICATIONS.— ‘‘(1) NOTIFICATION TO THE GOVERNOR.—The G overnor of a State shall be notified promptly— ‘‘(A) by the Secretary of Labor, upon making a deter- mination that a group of workers in the State is eligible for assistance under section 223; ‘‘(B) by the Secretary of Commerce, upon making a determination that a firm in the State is eligible for assist- ance under section 251; and ‘‘(C) by the Secretary of Agriculture, upon making a determination that a group of agricultural commodity pro- ducers in the State is eligible for assistance under section 293. ‘‘(2) NOTIFICATION TO COMMUNITY.— U pon making an affirmative determination under subsection (b)(1) that a community is eligible to apply for assistance under this sub- chapter, the Secretary shall promptly notify the community and the Governor of the State in which the community is located— ‘‘(A) of the affirmative determination; Timep e r i od.
