Gus. 348, 349. 1886. 57 CQAP. 34g8.—A.n act authorizing the lnter-State Rapid Transit Railway Company May 17, 1886. to build a bridge across the Kansas River. —-————-——-;— Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Inter-State Rapid- _ Inter-Qtate Rap- Transit Railway Company, a. corporation duly and legally organized “1‘T'°”**° R°*1· and existing under and by virtue of the laws of the State of Kansas, ;;1,{,;·;,¤;;;·g;,gg; its successors or assigns, be, and is hereby, authorized to construct and the Kansas Rivgr, maintain a bridge, and approaches thereto, over the Kansas River, in between Wynn- Wyandotte County, in the State of Kansas, between the city of Vlfyan- ;](°“° “"d I*°”·“· dotte and the city of Kansas, Kansas, at the point where said com- °°°' pany’s line of railway, as now projected, crosses said river, near the mouth thereof. Said bridge shall be constructed to provide for the passage of its railway trains, and, at the option of said company by which it may be built, may be used ihr the passage of wagons and lVagou and rmt vehicles of all kinds, for the transit of animals, and for foot passengers, ‘>¤dS¤· for such reasonable rates of toll as may he approved from time to time Tolls. by the Secretary of War. Sec. 2. That the bridge that shall be built under this act shall be Post-route. recognized and known as a post·route, upon which also no higher charge shall be made for the transmission over the same of the mails, the troops, and the munitions of war of the United States than the rate per mile paid for the transportation over the railroad or public highways leading to the said bridge · and it shall enjoy the rights and privileges of other post-roads in the United States. Sec. 3. That no bridge shall be erected or maintained under the au- Free navigation thority of this act which shall at any time substantially or materially ¤¤'¤ W l>¤ °‘>¤¤¤¤*· obstruct the free navigation of said river; and if any bridge erected °°‘ under such authority shall, in the opinion of the Secretary of War, ob- S¤¤¥¤¤¤'S’°!W¤ struct such navigation, he is hereby authorized to cause such change *° P'°"°”*· or alteration of said bridge to be made as will efectnally obviate such obstruction; and all such alterations shall be made and all such obstructions be removed at the expense of the owner or owners of said bridge; and in case of any litigation arising from any obstruction or alleged I·itigM=i¤¤· obstruction to the free navigation of said river caused or alleged to be ‘ caused by said bridge, the case may be brought in the circuit court of the United States in and for the district of Kansas: Provided, That Provinnothing in this act shall be so construed as to repeal or modify any of the provisions of law now existing in reference to the protection of the navigation of rivers, or to exempt said bridge from the operation of the same.
