DI¥.UNKARDS.—·wVhBHGVB1‘ any person residing in said Dismmee to manage es- trict, and owning any estate, real or personal, situate there1n, is uniit an °f‘ from the habitual use of intoxicating liquors to properly manage or control the same, the said court, on the petition of any creditor or relative of such person, or if there be no creditor or relative, upon the petition of any person living in said District, and upon summons being regularly served upon such person so alleged to be unfit to manage or control his property as aforesaid, commanding him to appear and answer such petition, may order a jury to be summoned to ascertain whether such person be an habitual drunkard and - unfit from that cause to manage and cont ol his property, and if the jury shall find that such person is an habitual drunkard and unfit to manage or control his property, such finding when coniirmed b * the court, shall be entered of record in said cause, and it shall be the duty of the court thereupon to appoint some fit person to be committee of the person so declared unfit to manage or control his pro erty as aforesaid. —b<>¤d of ¢°mmm€°· Such committee before entering upon the discharge of his duties shall execute a bond, with surety, to be approved by the said ccurt o1· one of the justices thereof, to the United States ina penalty e ual to the amount of the personal roperty and the yearly rents to be dlerived from the real estate of such person, conditioned for the faithful per- ·fP°“’°’¤·°‘°°· formance of his duties as such committee; and he shall have control of the said estate, real and ersonal, with power to collect all debts due said drunkard, and to adljust and settle all accounts owing by him, and to sue and be sued in his representative capacity. He shall apply the annual income of the estate of such habitual drunkard to the support of said person, and the maintenance of his family and education of his children; and shall in all other respects perform the same duties _ and have the same rights as pertain to committees of lunatics and idiots. d,§,§1§,f,‘Q,’ ‘j“,§‘§’,,‘g QQ When any person for whom a committee has been appointed unde1· t¤te.e¤¤· the provisions of this section shall become competent to manage his property on account of reformation in his habits, he may apply to said court to have said committee discharged and the care and control of his property restored to him; and if It shall appear by the verdict of a jury summoned therefor, or by afiidavits, or other evidence to the satisfaction of the court, that said applicant is a fit person to have the care or control of his property, an order shall be entered restoring such person to all tlge rights and privileges enjoyed before said committee was a ointe . — APP“*¤“°°S· Sec. 173. Pgrrnnumons.-The said probate court shall also have authority to approve contracts of apprenticeship, to determine questions between masters and apprentices, and to protect the rights of apprentices, as herein elsewhere provided for. _ ' (Rgggk 0* S“P’€m° ao. 174. `·THm CLERK.-··ThG clerk of said supreme court shall take ——oat1i, em. the oath and give bond with security, in the manner prescribed by law ·P°W°¤- for the clerks of the district courts of the United States. The said clerk shall have power to appoint assistant clerks, at such com ensation as may be authorized by the supreme court of the District of Columbia in eneral term, and may assign any of the assistant clerks in his office to duty in the said general or special terms of the court, except in the &c*QS;l§f*“*°l°’k mw nrobate term. Any of the duties of the clerk may be performed in ' his name by any of the assistant clerks, and such assistants may sign the name of the clerk to any process, certificate, and other official act required by law or by the practice of the court to be performed by the ‘clerk, and may authenticate said signature by aiiixing the seal of the court tlhereto when thle ical is necessary to its authentication.
