Heydeck, $47.65, in the remission of a bond which was for- feited by the failure of John McCarthy, of Tenakee, Alaska, to appear before the District Court of Juneau, Alaska, on October 6, 1922, the said John McCarthy being deceased on the date he was cited to appear. Be it e7IIUJted by the Senate and House 01 Repre8entatives 01 the United States of America in Oongress assembled, That theSecre- tary of the Treasury is authorized and directed to pay to Leon Freid- man, out of any money in the Treasury not otherwise appropriated, . the sum of $2,750, the amount of a fine paid by Leon Freidman in pursuance of a judgment entered upon a plea nolo contendere under. certain provisions of the so-called Lever Act previous to the time that the Supreme Court of the United States held such provisions void, the said plea and said payment being made under a stipulation as follows: "In consideration that the Attorney General and this court shall accept the plea nolo contendere which I hereby tender to the above-entitled indictment, I do hereby waive any and all fines which the court may see fit to impose upon me upon such plea, except in the event that the so-called Lever Act under which said indictment is found shall be declared unconstitutional by the Supreme Court of Ml\I'Ch 2 ,1929.
