(d) No law imposing restrictions, requirements, or penalties in relation to the employment of persons, the performance of services, the payment or receipt of compensation in connection with any claim proceeding or matter involving the United States applies to members of the Committee solely by reason of their membership on the Committee. §5201. Commandant: appointment; term; emoluments (a) There is a Commandant of the Marine Corps, appointed by the President, by and with the advice and consent of the Senate, for a term of four years, from officers on the active list of the Marine Corps not below the grade of colonel. (b) The Commandant of the Marine Corps, while so serving, has the rank of general. (c) An officer who is retired while serving as Commandant of the Marine Corps, or who, after serving at least two and one-half years as Commandant, is retired after completion of that service while serving in a lower rank or grade, may, in the discretion of the President, be retired with the grade of general and with retired pay based on that grade. § 5202. Assistant Commandant: detail; pay; succession to duties (a) An officer on the active list of the Marine Corps not restricted in the performance of duty may be detailed as Assistant Commandant of the Marine Corps. While so serving, he is entitled to the highest pay of his grade. (b) When there is a vacancy in the office of Commandant of the Marine Corps, or during the absence or disability of the Commandant, the Assistant Commandant and then the officers of the Marine Corps not restricted in the performance of duty on duty at Headquarters, Marine Corps, in order of seniority, shall perform the duties of the Conmiandant, unless otherwise directed by the President. § 5203. Director of Personnel: detail The Director of Personnel, Marine Corps, shall be detailed by the Commandant from officers of the Marine Corps on active duty who are not restricted in the performance of duty. §5204.
