350 the number of additional vacancies estimated for the next 12 months, minus the number of colonels designated for supply duty on the promotion list. (b) The Secretary shall furnish the appropriate selection board, convened under chapter 543 of this title to recommend officers for promotion to a grade below brigadier general, with the number of male officers of the Marine Corps designated for supply duty that may be recommended for promotion to the grade concerned. He shall determine this number, based upon the needs of the service, as of the date the selection board is convened. The number— (1) may not exceed the total number of male officers designated for supply duty in the promotion zone; and (2) may not be less than the product of the number of male officers designated for supply duty in the promotion zone and a fraction, of which the numerator is the number of male officers of the Marine Corps, not restricted in the performance of duty, in the same grade, that may be recommended for promotion in that fiscal year, and the denominator is the number of male officers of the Marine Corps, not restricted in the performance of duty, in the promotion zone for the grade concerned in that year. § 5760. Regular Navy, women line officers; Regular Marine Corps, women officers: numbers that may be recommended (a) The Secretary of the Navy shall furnish the appropriate selection board convened under chapter 543 of this title with the number of women officers on the active list in the line of the Navy that may be recommended for promotion to the grade of commander or lieutenant commander or the number of women officers on the active list of the Marine Corps that may be recommended for promotion to the grade of lieutenant colonel or major. This number, determined by the Secretary as of the date the selection board is convened, is equal to the number of vacancies existing in the grade concerned plus the number of additional vacancies estimated for the next 12 months, minus the number of officers on the promotion list for that grade. (b) The Secretary shall furnish the appropriate selection board convened under chapter 543 of this title with the number of women officers on the active list in the line of the Navy that may be recommended for promotion to the grade of lieutenant or the number of women officers on the active list of the Marine Corps that may be recommended for promotion to the grade of captain. This number, determined by the Secretary as of the date the selection board is convened, is equal to the number of women officers in the next lower grade who are eligible for consideration by the board concerned. § 5761. Navy; staff corps officers: numbers that may be recommended for promotion to grade of rear admiral The Secretary of the Navy shall furnish the appropriate selection board convened under chapter 543 of this title with the number of officers in any staff corps that may be recommended for promotion to the grade of rear admiral. This number, determined by the Secretary as of the date the selection board is convened, is equal to the number of vacancies existing in the grade of rear admiral in the corps
