"(2) If the Secretary concerned determines that the conditions under which a member described in paragraph (1) is discharged or separated do not warrant separation pay under this section, that member is not entitled to that pay. "(3) A member described in paragraph (1) who was not on the active-duty Hst when discharged or separated is not entitled to separation pay under this section unless such member had com- pleted at least five years of continuous active duty immediately before such discharge or release. For purposes of this paragraph, a period of active duty is continuous if it is not interrupted by a break in service of more than 30 days.". (b) Subsection (g)(2) of such section is amended by inserting ", other than section 1212 of this title," after "any other provision of law". (c) The amendments made by this section shall take effect on October 1, 1983. 10 USC 7572 note. REIMBURSEMENTS FOR ACCOMMODATIONS IN PLACE OF QUARTERS SEC. 912. (a) Paragraph (3) of section 7572(b) of title 10, United States Code, is amended to read as follows: "(3) The total amount of reimbursement under this subsection may not exceed $9,000,000 for fiscal year 1981, $6,300,000 for fiscal year 1982, $1,700,000 for fiscal year 1983, and $1,300,000 for fiscal year 1984.". (b) Section 3 of Public Law 96-357 (94 Stat. 1182; 10 U.S.C. 7572 note) is amended by striking out "September 30, 1982" and inserting in lieu thereof "September 30, 1984". 10 USC 1040. 10 USC 1036 note. ADVANCE PAYMENT OF TRAVEL AND TRANSPORTATION ALLOWANCES FOR ESCORTS AND ATTENDANTS OF DEPENDENTS SEC. 913. (a) Section 1036 of title 10, United States Code, is amended by adding at the end thereof the following new sentence: "Such allowances may be paid in advance.". (b) The last sentence of section 1040(a) of such title is amended by inserting ", and such expenses may be paid in advance" after "attendants". (c) The amendments made by subsections (a) and (b) shall apply to travel performed by escorts or attendants of dependents on or after the date of the enactment of this Act. PART B—RETIRED PAY MATTERS 10 USC 1401a note. LIMITATION ON APPLICABILITY OF ONE YEAR LOOK-BACK PROVISION SEC. 921. (a)(1) Subsection (e) of section 1401a of title 10, United States Code, is repealed. (2)(A) Notwithstanding the repeal of such subsection, the provi- sions of such subsection shall apply in the case of any member or former member of the Armed Forces eligible to retire on the date of the enactment of this Act for a period of three years after such date in the same manner such provisions would have applied had they not been repealed. (B) The amount of retired or retainer pay of any member or former member of the Armed Forces who was eligible to retire on the date of the enactment of this Act and who becomes entitled to
