พระบาทสมเด็จพระปรมินทรมหาภูมิพลอดุลยเดช มีพระบรมราชโองการโปรดเกล้าฯ ให้ประกาศว่า

Phra Bat Somdet Phra Paramin Maha Bhumibol Adulyadej has issued with his pleasure a great royal command that it be proclaimed as follows:

โดยที่ได้พิจารณาเห็นว่า การพิจารณาคดีเนื่องในการชุมนุมในมหาวิทยาลัยธรรมศาสตร์ระหว่างวันที่ ๔ ถึงวันที่ ๖ ตุลาคม ๒๕๑๙ นั้นได้ล่วงเลยมานานพอสมควรแล้ว และมีท่าทีว่าจะยืดเยื้อต่อไปอีกนาน ถ้าจะดำเนินคดีต่อไปจนเสร็จสิ้น ก็จะทำให้จำเลยต้องเสียอนาคตในทางการศึกษาและการประกอบอาชีพยิ่งขึ้น และเมื่อคำนึงถึงว่า การชุมนุมดังกล่าวก็ดี การกระทำอันเป็นความผิดทั้งหลายทั้งปวงก็ดี เกิดขึ้นเนื่องจากความไม่เข้าใจในสถานการณ์ที่แท้จริง เพราะเหตุแห่งความเยาว์วัยและการขาดประสบการณ์ของผู้กระทำความผิด ประกอบกับรัฐบาลนี้มีความประสงค์อย่างแน่วแน่ที่จะให้เกิดความสามัคคีในระหว่างชนในชาติ จึงเป็นการสมควรให้อภัยการกระทำดังกล่าวนั้น เพื่อเปิดโอกาสให้ผู้กระทำความผิด ทั้งผู้ที่กำลังถูกดำเนินคดีอยู่ และผู้ที่หลบหนีไป ได้ประพฤติปฏิบัติตนในทางที่ถูกที่ควร และกลับมาร่วมกันทำคุณประโยชน์และช่วยกันจรรโลงประเทศชาติให้เจริญรุ่งเรืองต่อไป

Whereas it has been considered and found that the trial of cases in relation to the demonstrations at Thammasat University between 4 and 6 October 2519 [1976] has taken a good deal of time and tends to lengthen for a longer deal of time, [for which reason] if the cases are continued until the end, the future of the accused in [respect of their] education and occupation could suffer more ruin; and after paying regard to [the fact] that the said demonstrations and all the acts constituting the offences occurred as a result of misunderstanding about the actual situation due to the immaturity and inexperience of the offenders, together with [the fact that] this Government has a determined desire to bring about harmony amongst the people in the Nation, it is [found] appropriate to pardon the described acts, in order to furnish the offenders, including those being prosecuted and those having escaped, with an opportunity to conduct and comport themselves in a right and correct manner and to return to participate in making beneficial contributions [to] and jointly promote further prosperity of the Nation;

จึงทรงพระกรุณาโปรดเกล้าฯ ให้ตราพระราชบัญญัติขึ้นไว้ โดยคำแนะนำและยินยอมของสภานิติบัญญัติแห่งชาติ ดังต่อไปนี้

Therefore, he grants with his gracious pleasure, by and with the advice and consent of the National Legislative Assembly, the enactment of the following Act:

มาตรา⁠๑⁠พระราชบัญญัตินี้เรียกว่า "พระราชบัญญัตินิรโทษกรรมแก่ผู้ซึ่งกระทำความผิดเนื่องในการชุมนุมในมหาวิทยาลัยธรรมศาสตร์ระหว่างวันที่ ๔ ถึงวันที่ ๖ ตุลาคม ๒๕๑๙ พ.ศ. ๒๕๒๑"

Section⁠1.⁠This Act is called the "Act Granting Amnesty to Those Who Have Committed Offences in Relation to the Demonstrations at Thammasat University Between 4 and 6 October 2519, 2521 BE".

มาตรา⁠๒⁠พระราชบัญญัตินี้ให้ใช้บังคับตั้งแต่วันประกาศในราชกิจจานุเบกษาเป็นต้นไป

Section⁠2.⁠This Act shall come into force as from the day of its publication in the Government Gazette onwards.

มาตรา⁠๓⁠บรรดาการกระทำทั้งหลายทั้งสิ้นของบุคคลใด ๆ ที่เกิดขึ้นในหรือเกี่ยวเนื่องกับการชุมนุมในมหาวิทยาลัยธรรมศาสตร์ระหว่างวันที่ ๔ ถึงวันที่ ๖ ตุลาคม ๒๕๑๙ และได้กระทำในระหว่างวันที่ ๔ ถึงวันที่ ๖ ตุลาคม ๒๕๑๙ ไม่ว่าจะได้กระทำในหรือนอกมหาวิทยาลัยธรรมศาสตร์ และไม่ว่ากระทำในฐานะเป็นตัวการ ผู้สนับสนุน ผู้ใช้ให้กระทำ หรือผู้ถูกใช้ หากการกระทำนั้นผิดกฎหมาย ก็ให้ผู้กระทำพ้นจากความผิดและความรับผิดโดยสิ้นเชิง

Section⁠3.⁠[As regards] all and every one of the acts of whatever persons which occurred in [the course of] or in relation to the demonstrations at Thammasat University between 4 and 6 October 2519 [1976] and which were committed between 4 and 6 October 2519 [1976], whether committed inside or outside Thammasat University and whether committed as principals, accessories, abettors, or abetted, if these acts are in breach of law, the persons committing them shall be discharged from the guilt and liabilities absolutely.

มาตรา⁠๔⁠ให้ศาลทหารกรุงเทพดำเนินการปล่อยตัวจำเลยทั้งหมดซึ่งถูกฟ้องในคดีหมายเลขดำที่ ๒๕๓ ก/๒๕๒๐ ของศาลทหารกรุงเทพ (ใช้กฎ ๖ ต.ค. ๑๙) และให้ศาลอาญาดำเนินการปล่อยตัวจำเลยทั้งหมดซึ่งถูกฟ้องในคดีหมายเลขดำที่ ๔๔๑๘/๒๕๒๐ ของศาลอาญา

Section⁠4.⁠The Bangkok Military Court shall implement proceedings for the release of all the accused who have been prosecuted in the Black-Number Case 253 Ko/2520 of the Bangkok Military Court (per the Regulations of 6 Oct 19) and the Criminal Court shall implement proceedings for the release of all the accused who have been prosecuted in the Black-Number Case 4418/2520 of the Criminal Court.

บรรดาการกระทำที่เป็นเหตุให้จำเลยถูกฟ้องในคดีตามวรรคหนึ่ง ถ้ามิได้รับนิรโทษกรรมตามมาตรา ๓ และการกระทำนั้นผิดกฎหมาย ก็ให้จำเลยพ้นจากความผิดและความรับผิดด้วย

[As regards] all the acts which caused the accused to be prosecuted in the cases under paragraph 1, if these acts do not enjoy the amnesty under paragraph 3 and they are in breach of law, the accused shall be discharged from the guilt and liabilities also.

มาตรา⁠๕⁠การนิรโทษกรรมตามพระราชบัญญัตินี้ไม่ก่อให้เกิดสิทธิแก่ผู้ได้รับนิรโทษกรรมในอันที่จะฟ้องร้องเรียกสิทธิหรือประโยชน์ใด ๆ ทั้งสิ้น

Section⁠5.⁠The amnesty under this Act does not entitle the persons enjoying the amnesty to claim any right or benefit whatsoever.

มาตรา⁠๖⁠ให้รัฐมนตรีว่าการกระทรวงกลาโหม รัฐมนตรีว่าการกระทรวงมหาดไทย และรัฐมนตรีว่าการกระทรวงยุติธรรม รักษาการตามพระราชบัญญัตินี้

Section⁠6.⁠The Minister of Defence, the Minister of Interior, and the Minister of Justice shall be in charge of this Act.

หมายเหตุ เหตุผลในการประกาศใช้พระราชบัญญัติฉบับนี้ คือ โดยที่รัฐบาลได้พิจารณาเห็นว่า การพิจารณาคดีเนื่องในการชุมนุมในมหาวิทยาลัยธรรมศาสตร์ระหว่างวันที่ ๔ ถึงวันที่ ๖ ตุลาคม ๒๕๑๙ นั้นได้ล่วงเลยมานานพอสมควรแล้ว และมีท่าทีว่าจะยืดเยื้อต่อไปอีกนาน ถ้าจะดำเนินคดีต่อไปจนเสร็จสิ้น ก็จะทำให้จำเลยต้องเสียอนาคตในทางการศึกษาและการประกอบอาชีพยิ่งขึ้น และเมื่อคำนึงถึงว่า การชุมนุมดังกล่าวก็ดี การกระทำอันเป็นความผิดทั้งหลายทั้งปวงก็ดี เกิดขึ้นเนื่องจากความไม่เข้าใจในสถานการณ์ที่แท้จริง เพราะเหตุแห่งความเยาว์วัยและการขาดประสบการณ์ของผู้กระทำความผิด ประกอบกับรัฐบาลนี้มีความประสงค์อย่างแน่วแน่ที่จะให้เกิดความสามัคคีในระหว่างชนในชาติ จึงเป็นการสมควรให้อภัยการกระทำดังกล่าวนั้น เพื่อเปิดโอกาสให้ผู้กระทำความผิด ทั้งผู้ที่กำลังถูกดำเนินคดีอยู่ และผู้ที่หลบหนีไป ได้ประพฤติปฏิบัติตนในทางที่ถูกที่ควร และกลับมาร่วมกันทำคุณประโยชน์ และช่วยกันจรรโลงประเทศชาติให้เจริญรุ่งเรืองต่อไป จึงจำเป็นต้องตราพระราชบัญญัตินี้

Note: The grounds for promulgation of this Act are as follows: Whereas the Government has considered and found that the trial of cases in relation to the demonstrations at Thammasat University between 4 and 6 October 2519 [1976] has taken a good deal of time and tends to lengthen for a longer deal of time, [for which reason] if the cases are continued until the end, the future of the accused in [respect of their] education and occupation could suffer more ruin; and after paying regard to [the fact] that the said demonstrations and all the acts constituting the offences occurred as a result of misunderstanding about the actual situation due to the immaturity and inexperience of the offenders, together with [the fact that] this Government has a determined desire to bring about harmony amongst the people in the Nation, [the Government has found] it appropriate to pardon the described acts, in order to furnish the offenders, including those being prosecuted and those having escaped, with an opportunity to conduct and comport themselves in a right and correct manner and to return to participate in making beneficial contributions [to] and jointly promote further prosperity of the Nation; therefore, it is necessary to enact this Act.
