FEDERAL ROADS ORDINANCE, 1959

An Ordinance to provide for the declaration of federal roads, bridges, ferries and other means of communication.

[31st August, 1957.]

IT IS HEREBY ENACTED by the Yang di-Pertuan Agong with the advice and consent of the Legislative Council as follows:

Short title. 1. This Ordinance may be cited as the Federal Roads Ordinance, 1959, and shall be deemed to have come into force on Merdeka Day.

Interpretation. 2. In this Ordinance—

“Minister” means the Minister charged with responsibility for transport.

Power to declare roads, etc., to be federal. 3. The Minister may after consultation with the Government of the State concerned, by order declare any road, bridge, ferry or other means of communication in any State to be Federal.

Order to be laid before House of Representatives. 4. Any order under section 3 shall be published in the Gazette and, as soon as possible thereafter, shall be laid before the House of Representatives; and if, at the next meeting of the House of Representatives after any such order is laid before it a resolution is passed annulling such order or any part thereof, such order or such part thereof shall, but without prejudice to the validity of anything previously done thereunder, be void as from the date of notification in the Gazette of the passing of such resolution.

Saving. 5. The roads, bridges and ferries specified or referred to in the declaration made by the High Commissioner on the fourteenth day of August, 1957, in pursuance of Item 91 of the Second Schedule of the Federation of Malaya Agreement, 1948, and published as Legal Notification 339 of 1957, are hereby declared to be federal, and such declaration shall, for the purpose of amendment, variation or revocation thereof, be deemed to be an order duly made under sections 3 and 4.
