' out Nonplevin of Land, which hath been accuftomed ' in the Time of his Progenitors and his own Time, c and the Pain alfo that was wont to enfue, in cafe the ' Land was not replevied in due Time. (2) Alfo it is

  • enacted, That none fhall lofe his Land from hence-
  • forth becaufe of Nonplevin; and that this Statute hold
  • Place as well in Pleas yet hanging, wherein no Judge-
  • ment is given, as in Time to come.'

ITEM, At the Requeft of the faid Commons made to our Lord the King in his faid Parliament, it is ordained and eftablifhed by our Lord the King, by the Affent of the Prelates, Earls, Barons, and other great Men, and the Commons aforefaid, That in a Writ of Debt brought againft divers Executors, the fame Executors, nor any of them, fhall have but one Effoin before Appearance, that is to fay, at the Sum- mons or Attachment, nor after Appearance they fhall have but one Effoin, as the Teftator fhould have had, fo that all the Executors do prefent the Perfon of the Teftator as one Perfon. (2) It is alfo enacted, That though the Sheriff do anfwer at the Summons, that fome of them have nothing whereby he may be fum- moned, yet there fhall an Attachment be awarded upon them. (3) And if the Sheriff anfwer, that he hath nothing whereby he may be attached, the great Diftrefs fhall be awarded, fo that at the great Diftrefs returned upon them, he or they that do firft appear in the Court fhall anfwer to the Plaintiff. (4) And although fome of them have appeared in the Court, and make Default at the Day that the great Diftrefs is returned upon the other, yet neverthelefs he or they fhall be put to anfwer, that firft appeared at the

great Diftrefs returned, (i) And in cafe the Judge-

1 ment pafs for the Plaintiff, he fhall have his judge-

ment and Execution againft them that have pleaded,
according to the Law heretofore ufed, and againft all
other named in the Writ, of the Goods of the Tef-
tator, as well as if they had all pleaded. (6) And it

Et ft le vifconte refpoigne qil nad riens par quei il poet eftre attache foit agarde le grande deftrefce iffint qe a la grande deftrefce retourne fur eux refpoigne al pleintif celui ou ceux qi pi imerment apparra ou apparrunt en court. Et tout foit ceo qe afcun de eux eit apparu en court & face defaute au jour qe la grande deftrefce foit retourne fur les autres jadumeins refpoigne celui ou ceux qi primes appara ou apparrunt a la grande deftrefce retourne. Et en cas qe jugement paffe pur le pleintif fe face le jugement & execution de- vers ceux qi unt pledez folonc la lei avant ufe & devers touz les autres nomez en le breif des biens le teftatour auxicome ils euffent treftouz pledez. Et eft a entendre qe fi nul en tieu cas voudra fuire felonc la lei qe cea enarere ad efte ufe qe franche- ment le peuffe faire nient contreftant ceil eftatut. CAP.
